S��L� <br /> AN ORDINANCE VACATING AN EASEMENT <br /> WHEREAS, after notice as required by law and ordinance, the <br /> Decatur City Plan Commission held a public hearing on the 3rd day of <br /> May, 1973 on the petition of GATES & JOHNSON COMPANY, to vacate an ease- <br /> ment described as follows: <br /> The Northeasterly 5 feet of Lot 57 of Country Ma.nor <br /> as per Plat recorded in Book 1575, Page 102 of the <br /> Records in the Recorder's Office of Macon County, <br /> Illinois; and I <br /> WHEREAS, the Decatur City Plan Commission recommended that the <br /> prayer of said petition be granted; and ' <br /> WHEREAS, the City Council has determined and does hereby determine <br /> that the public interest will be subserved by the vacation of said ease- <br /> ment above described. <br /> NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1. That upon the condition hereinafter set out, the <br /> easement hereinabove described and as shown by the plat thereof hereto <br /> attached and made a part hereof, be, and the same is hereby, vacated as <br /> a public easement. <br /> Section 2. That the vacation of said easement be, and it is <br /> hereby, expressly conditioned to become effective upon the payment to <br /> the City of Decatur of the sum of $50.00, which said sum is by the <br /> Council determined to be compensation equal to the benefits which will <br /> accrue to the abutting owner by reason of such vacation. <br /> PRESENTED this � day of May, 1973. <br /> PASSED by a three-fourths aye and nay vote of all members of <br /> the Council authorized b law to be elected this /L/,�; day of May, <br /> 1973, said vote being � Ayes and � Nays � <br /> APPROVED & RECORDED this J���ti-"„ day of May, 1973. <br /> . <br /> � n-�n1 MAYOR <br /> ATTEST: <br /> � CITY CLE <br />
