ORDINANCE NO. S�o� <br /> ORDINANCE GdZANTING SPECIAL USE PERMIT <br /> R-3 NURSfiRY SCHOOL <br /> TRINITY LUTHERAN CHURCH <br /> Wf�REAS, on the 6th day of April, 1972, after notice as re- <br /> quired by law and ordinance, the Decatur City Plan Commission held a <br /> public hearing upon the petition of TRINITY LUTHERAN CHURCH for a special <br /> use permit to operate a day care center or nuxaery school on premises in <br /> the City of Decatur, described as: <br /> Lots 4, 5, 6, 19, 20, 21 and 22 of Terrace Gardens <br /> Addition to the City of Decatur, as per Plat recor- <br /> ded in Book 300, page 83 of the Records in the Re- <br /> corder's Office of Macon County, Illinois <br /> and commonly known as 1960 East Johns Avenue, Decatur, Illinois; and <br /> i�hiEREAS, said Decatur City Plan Commission did recommend that <br /> the prayer of said petition be granted and did file a report of its find- <br /> ings with this Council in support of said recammendation; <br /> NOW THEREFORE� Bfi IT ORDAINED BY �iE QOUNCIL OF THE CITY OF <br /> DECATUR, I1.L.INOIS: <br /> Section 1. That the findings and recommendations of the <br /> Decatur City Plan Commission be re+�eived, placed on file and approved. <br /> Section 2. That upon the conditions hereinafter mentioned, <br /> an R-3 Special Use Permit to operate a day care center or nursery school <br /> be, and it is here by, granted to Trinity Lutheran Church for the premises <br /> aforesai d. <br /> Section 3. That said permit be, and it is hereby, condition- <br /> ed as provided in Section XXI. A.1.(1-6) of the Zoning Ordinance of the <br /> City of Decatnr, Illinois, the same being Ordinance No. 35I2, as arnend�d, <br /> and upon the fuzther con ditions that said pre�aises and the day care center <br /> or nursery school operated thereon be licensed by and meet all the appli- <br /> cable rules and regulations of the State of Tllinois with regard to such <br /> maintenance and operation, and further that said facil ity be used only for <br /> the care of the number of children permitted under the rules and regulations <br /> of the State as aforesaid not to exceed in number a total of 40 children, <br /> and further that shmuld said permittee fail to perform any or all of the <br /> aforesaid conditions, this permit shall terminate and be revoked. <br /> PRESENTfiD th i s _�� da y o f May, 1972. <br /> PASSED by a two-thirds aye and nay vote of all members of the <br /> Council authorized b law to be elected, said vote being 5 AYES and <br /> �_NAYS, this��$��day of May, 1972. <br /> APPROVED & RECORDSD this ` r,�day of May, 1972. <br /> ATTEST: MAYOR <br /> , , <br /> CITY CLfiRK � <br />
