. ` . . . _ � c� � � ORDINANCE NO.��7 �� AN ORDINANCE A�MENDING SPECIAL PERMIT FOR R-B RESIDENCE DBVELOPMENT PLAN. WHEREAS, the State of Illinois has made plans to widen and improve U. S. Route 51 North in the City of Decatur, adjacent to premises therein described as: The Northwest Quarter (NW'�4) of the Southwest Quarter (SVV�4) of the Southwest Quarter (S4V14) Secti,�n 26, Township 17 North, Range 2 East of the 3rd P.M. , and now of record as Northe Towne Village, as recorded in Book 1575, page 100 of the Records in the Recorder 's Office of Macon County, Illinois; and will require additional right-of-way from said premises extend- ing over the West 30 feet thereof; and WI-IEREAS, by Ordinance No. 5354, passed August 24, 1970, a special use permit was authorized for an R-5 Residence Development Plan for Russell Replogle and others on said premises in accordance with a plot plan by said oYdinance adopted by refe rence which said development cannot be made in accordance with said plot plan because of the requiring of additional right-of-way for said highway improve- ment; and WHEREAS, on August 5, 1971, the Decatur City Plan Commission after notice as provided by law, held a public hearing upon the peti- tion of the Director of C ommunity Development to modify said special use permit to ref lect the dedication of said needed right-of-way; and WHEREAS, said City Plan Commission did recommend that �he prayer of said petition be granted and said special use permit modi- fied in accordance there with. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the report and recommendation as aforesaid of the Decatur City Plan Commission be received, placed on file and ap- proved. Section 2. That the special use permit heretofore granted as aforesaid be, and the same is hereby, amended and modified as set out herein and upon the plot plan hereto attached and hereby made a part hereof.
