�� <br /> ORD INA NCE NO. ���°J���--- <br /> AN ORDINANCE DENYING VARIATION <br /> WHEREAS, on May 11, 1971, pursuant to notice as required, <br /> the Decatur Zoninq Board of Appeals held a public hearing upon the <br /> petition of CLAYTON L. SCHMAHL and PHYLLIS E. SCHMAHL for a varia- <br /> tion of minimum lot size requirements under the Zoning Ordinance of <br /> _ the City of Decatur, Illinois, upon premises described as: <br /> The East 85 feet of Lot 10 in Block 2 of Cherry- <br /> dale First Addition, as per Plat recorded in Book <br /> 958, page 52 of the Records in the Recorder's Of- <br /> fice of Macon County, Illinois, commonly known as <br /> 3118 Cherry Drive, <br /> situated in the City of Decatur, in the County of Macon, and State <br /> of Illinois; and <br /> WHEREAS, after due consideration and upon a vote of less <br /> than five members thereof, said Zoning Board of Appeals did deny the <br /> prayer of said petition and did refuse to vary the provisions of said <br /> Zoning Ordinance; and <br /> WHEREAS, in the time and manner as prescribed by ordinance, <br /> petitioners did file with the City Clerk their appeal from the afore- <br /> said decision of said Zoning Board of Appeals; and <br /> WHEREAS, the Council of the City of Decatur, Illinois, has <br /> examined the record herein, the exhibits submitted by petitioners and <br /> the recommendations of the Department of Community Development and has <br /> heard petitioner and the evidence and remarks submitted and is well ad- <br /> vised in the premises. <br /> NOW THEREFORE, BE IT ORDAINED BY THE O�UNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1. That the decision of the Decatur Zonin g Board of <br /> Appeals on the application of Clayton L. Schmahl and Phyllis E. Schmahl <br /> for a variation in the m inimum lot size requirements established by the <br /> Zoning Ordinance of the City of Decatur, Illinois, for the premises afore- <br /> said be, and the same is here by, approved and affirmed. <br /> Section 2.
