� <br /> w <br /> t � <br /> ORDINANCE NO. �� �� <br /> AN ORDINANCE VACATING A PORTION OF STREET - <br /> NORTH SUNaIIT AVENUE <br /> WI-�REAS, in connection with the improvement of West Grand <br /> Avenue in the City of Decatur, Illinois, the northeast quadrant of <br /> the intersection of said street with IJorth Summit Avenue will be <br /> modified and improved so that the below described portion of said <br /> North Summit Avenue will no longer be necessary or desirable for <br /> use as a public street or way, and <br /> 1nMfiREAS, the public interest will be subserved by vacating <br /> said portion of said street and the public will be relieved frorn <br /> the further burden and responsibility for maintaining the same, and <br /> WHEREAS, after such improvement there will be no public service <br /> facilities thereon. <br /> NOW THEREFORfi, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS; <br /> Section 1. That the above described portion of North Summit <br /> Avenue be, and the same is hereby, vacated as a public street inasmuch <br /> as the same is no longer required for public use as a street and the <br /> public interest will be subserved by such vacation and the public <br /> will be relieved from any further burden or responsibility of main- <br /> taining the same, said portion of said street being shown on the plat <br /> thereof hereto attached and here by made a part hereof. <br /> Section 2. That the benefits which will accrue to the owner <br /> of abutting property by reason of the vacation aforesaid is deter- <br /> mined to be in the judgment of the Council equal in value to the sum <br /> of $4,600.00. <br /> Section 3. That the vacation herein provided for is made upon <br /> the express candition that there shall be received by the City of <br />
