. . •.�- . _ ORDINANCE NO. -..� =;� ,�,• � AN ORDINANCB VACATING P[1BLIC WAY - , INTfiRURBAN WAY I�iEREAS, a petition has been rec�ived from ROY SWARTZ AND O'fHERS requesting the vacation by th� City Council of that certain public way ta�tnty-five (25) feet in width, sitnated in Oak Crest Addition, �x- tending west�rly froa North Oak Crest Avenue about 50 feet south of West William Street and described as: Beginning at th� Northeast Cor�r of Lot 2 of Oak Crest Addition of Outlots to the City of Dccatur, as per Plat recorded in Book 149, page 477 in the Records in the County Recorder 's Office of Macon County, Illinois; thence w�esterly along the north line of said Lot 2 175 feet to the Northwe�t Corner of said Lot 2; thence north 25 fect; thence east parall�l with the north line of sa id Lot 2 175 fe�t to the west line of North Oak Crest Aveaue ; thence south 25 f�et to the place of beginning. and NhiBREAS, petition�rs owr� all premise� abutting the aforedescribed public way, and W1�REAS, sa�id way is no longer useful to the public or to the City or to the owners of property abutting ther�on as a public way, and WE�REAS, the public interest will be subserved by vacating said public waq and the public will be relieved from the burden and responsi- bility of aiaintaining the same . NOW THSRfiFORE� Bfi IT ORDAINED BY THE CJOUNCIL OF THE CITY OF DECATUR, ILLINOIS. Section 1. That the above-described public way be, and the same is hereby, subject to th� exceptions, reservations and conditions h�re_ inafter set out, vacated as a pu blic �vay inar>much as the same is no long�r required for public use and the public interest will be subserved by such vacation and the public �vill be relieved from the burden and responsibility of maintaining th� saffie, �oaid public way being shown on the plat thereof hereto attached and he re by made a part hereof. Section 2. 2hat there is here by reserved in, over, along and under the way h�reinabove vacated, to the City of Decatur ,Illinois, and to the public and to those utilities and companies, as the ca�e �ay be, owning public service facilities, mains, sew�rs, telephone and electrical or other public utilities, such property, rights-of-way and easements as ar� or aaq be necessary or desirabl� for continuing public service by means of such facilities and for the naintenance, renewal, and r�construction thereof with the right of ingress and egress for such purposes.
