ORDINANCE NO. ��;�-- .�/ .0� �/� •�v11CROFILM ' ree.... �tecorder oi 1� � .� � AN ORDINANCE VACATING PUBLIC WAY -�� INTERURBAN WAY ` 1nhiEREAS, a petition has been received from ROY SWARTZ AND OTHERS � requesting the vacation by the City Council of that certain public way twenty-five (25) feet in width, situated in Oak Crest Addition, ex- tending westerly from North Oak Crest Avenue about 50 feet south of West Willia�s Str�Qt an� �escrib2d as: Beginning at the Northeast Corner of Lot 2 of Oak Crest Addition of Outlots to the City of Decatur, as per Plat recorded in Book 149, page 477 in the Records in the County Recorder 's Office of Macon County, Illinois; thence xesterly along the north line of said Lot 2 175 feet to the Northwest Corner . of said Lot 2; thence north 25 feet; thence east parallel with the north line of said Lot 2 175 feet to the west line of North Oak Crest Avenue ; thence south 25 feet to the place of beginning. and tn1HEREAS, petitioners own all prem ises abutting the aforedescribed public way, and I WHEREAS, said way is no longer useful to the public or to the City or to the owners of property abuttinr� thereon as a pul�Iic ��a„ ar,� WEIEREAS, the public interest will be subs�rved by vacating said public way and the public will be relieved from the burden and responsi- bility of maintaining the same . NOiV THEREFORE� BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS. Section 1. That the above-described public way be, and the same is hereby, subject to the exceptions, reservations and conditions here- inafter set out, vacated as a pu blic way inasmuch as the same is no longer required for public use and the public interest will be subserved by such vacation and the public will be relieved from the burden and responsibility of maintaining the same, said public way b�ing shovm on the plat thereof hereto attached and he re by made a part hereof. Section 2. That there is hereby reserved in, over, along and under the way hereinabove vacated, to the City of Decatur ,Illinois, and to the public and to those utilities and companies, as the case map be, o�rming public service facilities, mains, seN:�rs, telephone and electrical or othex public utilities, such property, rights-of-way and easements as are or may be necessary or desirable for continuing public service by means of such facilities and for the maintenance, renewal, and reconstx�nction thereof with the right of ingress and egress for such purposes. �
