c, � , / , � ; v ORDINANCE NO. �� D / AN ORDINANCE VACATING ALLEY 200 block North Broadway WHEREAS, there exists in the City of Decatur, Illinois, an easement for a pu blic alley which has not been used or improved or otherwise opened to vehicular traffic for many years and the same could be made useful only by the expenditure of large sums of money; and WHEREAS, said alley extends easterly from North Broadway Street about 100 feet north of and parallel with East Prairie Street and terminates at private property, which private property along with all other property abutting said alley is owned by Decatur Newspapers, Incorporated, which company has petitioned this Council for the vaca- tion of said alley described as; Commencing at the northcvest corner of Lot 7 in Block 10 of Prather, Martin & Gatling's Subdivision as per Plat recorded in Book O, page 553 of the Records in the Recorder's Office of Macon County, Illinois; thence East to the northeast corner of said Lot 7; thence north 16 feet ; thence west to the west line of said Block 10; thence South 16 feet to the place of beginning; an d WHEREAS, said portion of said alley is no longer useful to the public or to the City or to the owners of property abutting thereon as an alley; and WHEREAS, the public interest will be subserved by vacating said alley and the public will be relieved from the furthe r burden and res- ponsibility of opening up, impro ving or maintaining the same and no pro- perty will be damaged by the vacation thereof. NOW THEREFORE, BE IT ORDAINED BY THE �UNCIL OF THE CITY OF DECATUR, ILLINOIS: Section l. That the above described alley be, and the same is hereby, vacated as a public alley or way subject to the exceptions and reservations hereinafter set out, inasmuch as the same is no longer re- quired for public use and the public interest will be subserved by such vacation and the public will be relieved from the further burden and re- sponsibility of opening, improving and maintaining said alley, the same being shown on the plat thereof hereto attached and hereby made a part hereof. Section 2. That there is hereby reserved in, over, along and under the street hereinabove vacated, to the City of �kcatur, Illinois, and to the public and to those utilities and companies, as the case may be, owning public service facilities , mains, sewers, telephone and elec- trical or other public utilities, such property, rights-of-w�ay and ease- me nts as are or may be necessary or desirable for continuing public ser- vice by means of such facilities and for the maintenance, and renewal, and reconstruction thereof with the right of ingress and egress for such pu r po se s.
