<br /> � WHEREA there exists in the City of Decatur, Illinois, an
<br /> easement for a public alley which has not been used or improved or
<br /> � otherwise opened to vehicular traffic for many years and the same
<br /> - could be made useful only by the expenditure of large sums of money;
<br /> � and
<br /> WHEREAS, sa id alley extends easterly from North Broadway `
<br /> Street about 100 feet north of and parallel with East Prairie Street
<br /> and terminates at private property, which private property along with
<br /> aIl other property abutting said alley is owned by Decatur Newspapers,
<br /> Incorporated, which company has petitioned this Council for the vaca-
<br /> tion of said alley described as:
<br /> Commencing at the northcvest corner of Lot 7 in Block
<br /> 10 of prather, Martin & Gatling's Subdivision as pez
<br /> Plat recorded in Book O, page 553 of the Records in
<br /> the Recorder's Office of Macon County, Illinois; thence
<br /> � East to the northeast corner of said Lot 7; thence north
<br /> 16 feet ; thence west to the west line of said Block 10;
<br /> thence South 16 feet to the place of beginning;
<br /> and
<br /> WHEREAS, said portion of said alley is no longer useful to
<br /> the public or to the City .or to the owners of property abutting thereon
<br />� as an alley; and .
<br /> WHEREAS, the pu blic interest will be subserved by vacating said
<br /> alley and the public will be relieved from the further burden and res-
<br /> ponsibility of opening up, impro ving or maintaining the same and no pro-
<br /> perty will be damaged by the vacation thereof.

<br /> NOW THEREFORE, BE IT ORDAINED BY THE OOUNCIL OF THE CITY OF
<br /> DECATUR, ILLINOIS: �
<br /> , . Section 1. That the above described alley be, and the same is
<br /> hereby, vacated as a public alley or w�ay subject to the exceptions and
<br /> reservations hereinafter set out, inasmuch as the same is no longer re-
<br /> quired for public use and the public interest will be subserved by such _
<br /> � vacation and the public will be relieve� from the further burden and re-
<br /> sponsibility of opening, improving and maintaining said alley, the same
<br /> being shown on the plat thereof hereto attached and hereby made a part
<br /> hereof.
<br /> Section 2. That there is hereby reserved in, over, along and
<br /> under the street hereinabove vacated, to the City of . �kcatar, Illinois,
<br /> _ and to the public and to those utilities and companies, as the case may
<br /> be, owning public service facilities , mains, sewers, telephone and elec-
<br /> trical or other public utilities, such property, rights-of-w�ay and ease-
<br /> ments as are or may be necessary or desirable for continuing public ser-
<br /> vice by means of such facilities and for the maintenance, and rene�val,
<br /> and reconstruction thereof with the right of ingress and egress for such
<br /> purposes.
