I <br /> .. ,.. /. <br /> -t t <br /> � � <br /> ORDINANCE NO. ���/ <br /> I <br /> AN ORDINANCE VACATING A PORTION OF STREET -- <br /> SAMUELS STREET <br /> �na-iEREAS, a petition has been receivsd by the City from <br /> ARCHER, DANIELS, MIDLAND COMPANY, the ow�ner of all property <br /> a butting thereon except the South 726 feet of the west side <br /> thereof, requesting the vacation by the City Council of a por- <br /> tion of that certain street in the City of Decatur, Illinois, <br /> commonly known as North Samuels Street, said portion more par- <br /> ticularly described as: <br /> Commencing at the northwest co rner of the intersec- <br /> tion of East Division Street and existing North <br /> Samuels Street in the City of Decatur, Illinois, <br /> which point is the southeast oorner of Lot 9 of Race- <br /> I-and Plat C, an addition to the �=ity of Decatur, as <br /> per plat recorded in Book 335, page 194 of the Records <br /> in the Recorder's Office of Macon County, Illinois; <br /> thence north along the east line of said Lot 9 and the <br /> east line of Lot 4 of said Race-Land Plat C to the south <br /> line of East Faries Parkway; thence east 50 feet along <br /> the south line of said Faries parkway; thence south paral- <br /> lel to the east lines of said Lots 4 and 9 to the south <br /> line of Lot 10 of said Race-Land Plat C; thence west 50 <br /> feet to the place of beginning; <br /> and <br /> t+1HEREAS, there has been received by this Council the Agree- <br /> ment of QOODAI;.fi TRUST NO. 1, DATED MARCH 1, 1959, the owner of the <br /> premises abutting said South ?26 feet of said portion of said <br /> street by which agreement said Trust does undertake to support the <br /> petition aforesaid; and <br /> WHEREAS, petitioner has offered to relocate, construct and <br /> improve a new street more useful to the public and to dedicate right- <br /> of-way for the same over land owned by petitioner approximately 1,000 <br /> feet westerly from the current location of said street; and <br /> WHEREAS, said portion of said Samuels Street is poorly drained <br /> and maintained to the extent that the bituminous surface formerly <br /> existing thereon has disintegrated so that the same could be repaired <br /> or replaced only at considerable expense to the public; and <br /> t�IEREAS, the existing portion of said street is used almost ex- <br /> clusively by large trucks entering into and exiting from the process- <br /> ing plant of petitioner; and <br /> WI-iEF�AS, the relocation of said street will greatly relieve the <br /> traffic congestion currently existing on East Faries Parkway in the <br /> vicinity of said portion of said Samuels Street and will be condusive <br /> to greater traffic safety on said portion of said Faries Parkway for <br /> the benefit of persons using the same; and <br />
