The Consulting Engineer expressly acknowledges,recognizes and agrees that the only authority to <br /> approve change orders to this Agreement or the Scope or Services or the cost(s)therein is with the <br /> City Council of the City. <br /> SECTION II. BASIC SERVICES <br /> A. CONSTRUCTION INSPECTION PHASE. <br /> The Consulting Engineer shall,after written authorization to proceed with the Construction Inspection <br /> Phase: <br /> 1. General Duties. The Consulting Engineer shall consult with and advise the City's Representative <br /> and act as its representative as provided herein and in the General Conditions of the construction <br /> contract for the Project. The primary responsibility of the Consulting Engineer in this phase of <br /> the work shall be quality control inspection of the materials,construction methods and techniques <br /> to assure that the Contractor builds the project in accordance with the plans and specifications. <br /> 2. Construction Inspection and Reporting. The Consulting Engineer shall make visits to the site at <br /> intervals appropriate to the various stages of construction to observe as an experienced and <br /> qualified design professional the progress and quality of the executed work of the Contractor and <br /> to determine in general if such work is proceeding in accordance with the Contract Documents. <br /> During such visits and on the basis of on-site observations,the Consulting Engineer shall keep the <br /> City's Representative informed of the progress of the work, shall endeavor to guard the City <br /> against defects and deficiencies in such work and may disapprove or reject work failing to <br /> conform to the Contract Documents. Formal notification of the progress of work shall be in the <br /> form of bi-weekly project progress meetings held between the Consulting Engineer,Contractor <br /> and City's Representative. Project schedule updates shall be submitted to the City's <br /> Representative in writing. <br /> 3. Review of Technical and Procedural Aspects. The Consulting Engineer shall review and approve <br /> (or take other appropriate action in respect to Shop Drawings,the results of tests and inspections <br /> and other data which each Contractor is required to submit, determine the acceptability of <br /> substitute materials and equipment proposed by the Contractor(s),and receive and review(for <br /> general content as required by the Specifications)maintenance and operating instructions, <br /> schedules,guarantees,bonds and certificates of inspection which are to be assembled by the <br /> Contractor(s). <br /> 4. Contract Documents. The Consulting Engineer shall receive from each Contractor and review for <br /> compliance with contract documents all required document submissions including but not limited <br /> to Performance and Payment Bonds,certificates of insurance report forms required by any City, <br /> State or Federal law or rule or regulation and submit the forms to the City's Representative for <br /> final approval. <br /> 5. Conferences and Meetings. The Consulting Engineer shall attend meetings with the Contractor, <br /> such as pre-construction conferences,progress meetings,job conferences, and other project- <br /> related meetings, and prepare and circulate copies of the minutes thereof to the City's <br /> Representative. <br /> 6. Documentation. The Consulting Engineer shall prepare all documentation and provide the same <br /> to meet the-requirements defined in the Illinois Department of Transportation Construction <br /> Manual and Documentation Guide("Manual"). The Manual used shall be the most current at the <br /> time of inspection.Documentation shall be available for review by the City's Representative at <br /> all times.
