Item Coversheet Page 1 of 2 <br /> M <br /> Public Works <br /> DATE: 3/10/2017 <br /> MEMO: 2017-22 <br /> TO: Honorable Mayor Moore Wolfe and City Council Members <br /> FROM: Tim Gleason,City Manager <br /> Richard G.Marley,P.E.,Public Works Director <br /> SUBJECT: Resolution Terminating an Agreement with AECOM for Design of the Brush College Rd Overpass Across the <br /> Norfolk Southern Track Yard,City Project 2009-33 <br /> SUMMARY RECOMMENDATION: It is recommended that the City Council approve the attached Resolution terminating an <br /> Engineering Services Agreement with AECOM Technical Services,Inc.(AECOM)of Decatur,IL,to prepare final design plans <br /> and bid documents for the Brush College Road Bridge over the Norfolk Southern rail yard south of Faries Parkway. <br /> BACKGROUND: <br /> In April 2016,the City made a Tiger VII Grant Application for$20 million in Federal funds to design and build the Brush College <br /> Road/Faries Parkway Grade Separation and Improvement Project. Later in July 2016,the City learned it was not selected for a <br /> grant. <br /> In order to prepare for the next anticipated round of TIGER grants,the City asked for a debriefing from the US Department of <br /> Transportation to learn of short-comings in the City's grant application. Staff was advised that the most significant short-coming <br /> was that the City is not far enough along on the project to compete well against other applicants. The DOT officials advised the <br /> City to take steps to move the project along towards implementation including acquisition of needed rights-of-way. The City still <br /> had access to slightly more than$2.0 million in Illinois Job Now!Grant funds,but those funds were currently obligated to pay for <br /> an engineering design contract. City staff discussed options with the Illinois Department of Transportation grand administrators <br /> and learned that the funds could be re-allocated for the purchase of rights-of-way provided that the engineering services agreement <br /> fund obligation was removed by terminating the engineering design agreement with AECOM. <br /> CONTRACT TERMINATION PROCESS: The City's Professional Engineering Service Agreement contains a termination <br /> provision. The City may terminate a contract provided the Consulting Engineer is given not less than fifteen(15)calendar days <br /> prior written notice of the intent to terminate,and an opportunity for consultation with the City prior to termination. That process <br /> has been followed and completed. <br /> PRIOR COUNCIL ACTION: <br /> 1. May 18,2015-City Council approved Resolution R2015-54,authorizing a Professional Engineering Services Agreement <br /> between the City of Decatur and AECOM Technical Services,Inc.(AECOM)of Decatur,IL,for the not-to-exceed amount <br /> of$2,156,599 to prepare final design plans and bid documents for the Brush College Road Bridge over the Norfolk Southern <br /> rail yard south of Faries Parkway. <br /> 2. May 18,2015-City Council approved Resolution R2015-55,authorizing a Local Agency Agreement for State Participation <br /> to fund$2,006,014 of the project costs through an Illinois Jobs No!Grant. <br /> 3. July 16,2013-City Council approved Resolution R2013-71,authorizing a change order to the agreement with URS <br /> Corporation to provide an additional$39,998. The total design agreement increased to$1,438,712.35. <br /> 4. November 9,2011-City Council approved Resolution R2011-175,authorizing a change order to the agreement with URS <br /> Corporation to provide an additional$587,714 to expand the project to include a structure crossing Faries Parkway. The total <br /> design agreement increased to$1,398,714.35. <br /> 5. November 21,2011-City Council approved Resolution R2011-177,authorizing an agreement with the Norfolk Southern <br /> Corporation in the amount of$26,845 to review and comment on the preliminary design for the proposed rail yard crossing. <br /> 6. July 6,2010-City Council approved Resolution R2010-140,authorizing an engineering design services agreement with <br /> URS Corporation(now AECOM)to perform preliminary design work to improve the Brush College Road crossing of the <br /> Norfolk Southern rail yard south of Faries Parkway. The design services agreement was for$811,000 and was paid for by an <br /> "Illinois Jobs Now!"grant from the State of Illinois. <br /> 7.
