RESOLUTION NO. R2017-53 RESOLUTION ACCEPTING THE BID AND AUTHORIZING THE EXECUTION OF A CONTRACT WITH ENTLER EXCAVATING COMPANY,INC. FOR NELSON PARK NEIGHBORHOOD COMBINED SEWER SEPARATION PROJECT CITY PROJECT 2012-22 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the tabulation of bids received for City Project 2012-22,Nelson Park Neighborhood Combined Sewer Separation Project, and presented herewith, be received and placed on file. Section 2. That the bid of Entler Excavating Company, Inc. be accepted and a contract in the amount of$3,503,727.83 be awarded accordingly,pending IEPA approval of award and receipt of an IEPA loan offer for the project; and that a contingency for construction cost overruns be authorized in an amount not to exceed $103,300.63. Section 3. That the changes in the above-described agreements are germane to said contract, as signed, and such changes are in the best interest of the City of Decatur and are authorized by law. Section 4. That the Mayor and City Clerk be, and they are hereby authorized and directed to execute a contract between the City of Decatur, Illinois, and Entler Excavating Company, Inc, as the lowest responsive,responsible bidder for said plan, for their bid price of$3,503,727.83; after IEPA loan approval. Contingencies in the amount of$103,300.63 will be included in the IEPA loan for construction cost overruns for a total not to exceed cost of$3,607,028.46.
