INFORMATION FOR BIDDERS
The Bidder's attention is directed to the fact that all applicable state laws, municipal
ordinances, and the rules and regulations of all authorities having jurisdiction over construction for
the project shall apply to the Contract throughout, and they will be deemed to be included in the
Contract the same as though herein written out in full.
No interpretation of the meaning of the plans, specifications or other pre-bid documents
will be made to any Bidder orally. Every request for such interpretation should be in writing
addressed to Charles W Gunthrie, P.E., Project Manager, at Blank, Wesselink, Cook, &
Associates, Inc., 2623 E Pershing Rd, Decatur, Illinois 62524, and to be given consideration must
be received at least five (5) days prior to the date fixed for the opening of bids. Any and all such
interpretations and any supplemental instruction will be in the form of written addenda to the
Contract Documents which, if issued, notification will be e-mailed to all prospective Bidders (at
the respective e-mail addresses furnished for such purposes), not later than three (3) calendar days
prior to the date fixed for the opening of bids. Failure of any Bidder to receive any such
addendum or interpretation shall not relieve such Bidder from any obligation under their bid as
submitted. All addenda so issued shall become part of the Contract Documents. It shall be the
responsibility of each Prospective Bidder to verify that each addendum has been received
applicable to the project. Addenda may also be viewed on the City's web site at
www.decaturil.gov /Department/ Public Works / Contractor Project Bid Information, and at
www.DecaturBlue.com.
The City of Decatur maintains City project information on the City's web site at
www.decaturil.gov/Departments/Public Works /Contractor Project Bid Information. It lists the
current projects at the City with bid information including bid opening dates and current bid
holders. It is recommended that all Prospective Bidders check this Information on the City's web
site and at www.DecaturB]ue.com for the status of the particular project they are interested in
bidding prior to turning in bids.
The successful Bidder, upon award of a Contract, shall commence work on the date
specified in the "Notice to Proceed" and shall substantially complete all work in accordance with
the time allocated in the contract. Should the Contractor fail to substantially complete all work in
the allotted time period, liquidated damages shall be assessed as outlined in the General
Conditions.
All Bidders shall comply with Sec. 436 of H.R. 3547, "The Consolidated Appropriations
Act, 2014", which specifies that all "iron and steel products" used in the project are produced in
the United States.
Bidders shall not discriminate on the basis of race, color, national origin or sex in the
performance of this contract. The Contractor shall carry out applicable requirements of 40 CFR
Part 33 in the award and administration of contracts awarded under EPA financial assistance
agreements. Failure by the Contractor to carry out these requirements is a material breach of this
contract which may result in the termination of this contract or other legally available remedies.
Attention of the bidders is directed to the arrangement and contents of the contract
documents and Specifications with reference to the project. One extra bid form is included,
detached from the remainder of the contract documents. Such detached bid may be completed and
submitted as the Contractor's bid.
9
