15. Records. The CIRDC shall be responsible for responding to Freedom <br /> of Information Act requests and subpoenas seeking records of the <br /> CIRDC. When practicable and advisable, the CIRDC will make <br /> reasonable attempts to consult with the Party or Parties they pertain to <br /> prior to releasing any records. <br /> 16. Release and Indemnification. To the extent permitted by law, each <br /> Party hereto does hereby fully and forever release and discharge and <br /> indemnify the other Parties, and the Council, Board members, <br /> Trustees, employees, officers and agents of same, in both individual <br /> and official capacities, from any and all claims, demands, damages, <br /> rights of action or causes of action, present or future, whether due to <br /> negligence or otherwise, resulting from or arising out of the <br /> compliance, or attempted compliance, by same with the terms and <br /> provisions hereof. <br /> 17. Staffina. The Parties agree that the employees currently employed by <br /> the City of Decatur in the Decatur Police Department Communications <br /> Center shall be offered and, if they accept, provided initial employment <br /> with the CIRDC. Those City of Decatur employees currently covered <br /> under a collective bargaining agreement shall be paid a wage in an <br /> amount equal to the wage they are earning from the City of Decatur at <br /> the time their positions are eliminated with the City of Decatur and this <br /> Agreement is implemented. In addition, CIRDC shall provide <br /> comparable benefits to these employees as provided in their <br /> employment with the City of Decatur, specifically health insurance and <br /> seniority benefits. <br /> Those employees employed in the Decatur Police Department <br /> Communications Center who are not covered under a collective <br /> bargaining agreement,that accept employment with the CIRDC, shall <br /> be paid in an amount equal to the rate of pay provided for the highest <br /> step of an Emergency Communications Specialist as set forth in the <br /> most current City of Decatur collective bargaining agreement, along <br /> with the comparable benefits as set forth above in this Section. <br /> Nothing in this Section or Agreement shall operate as a <br /> guarantee of any future benefit(s),future employment or continued <br /> employment or as any condition of employment except as set forth <br /> specifically herein. <br /> 18. Signatures. Each signator to this Agreement warrants and represents <br /> that such signator is duly authorized to execute this Agreement on <br /> behalf of the party for who the Agreement is signed. The Parties <br /> agree that this Agreement may be signed by the Parties on separate <br /> pages for convenience and that when signed constitutes a fully <br /> executed contract. <br /> 4 <br />
