OR.DINANCE NO. 2019-�►� ORDINANCE AUTH4RIZING CC?NSUMPTION OF ALCOHOLIC LIQUOR ON PUBLIC RIGHTS-OF-WAY AND IN CENTRAL PARK -DECATUR SMOKIN' BBQ FESTTVAL- WHEREAS,the Decatur Smokin' BBQ Festival, has requested the closure of public streets and Central Pazk in downtown Decatur beginning Friday, September 13,2019 and cantinuing through Saturday, September 14,2019; and, WHEREAS, it is the intention of the Decatur Smokin' BBQ Festival to offer alcohoiic beverages for sale to patrons for consumption at this event; and, WHEREAS,such consumption of alcoholic liquor on public rights-of-way and in Central Park requires the express approval ofthe City Council;and, WHEREAS,the Council fmds that it would be in the best interest of the Decatur Smokin' BBQ Festival and of the City of Decatur that such consurnption of alcoholic liquor as described be permitted for said limited time period. NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DECATUR,ILLTNOIS: Section 1.That on the days listed herein,and only on such days, between the hours listed oppasite each,alcoholic beverages may be consumed at,in or an those portions of public rights-of-way described in Section 2 hereof,and in Central Pa.rk located in downtown Decatur,said days and hours being particularly described as follows: Friday, September 13,2019 5:00 p.m.-10:00 p.m. Saturday, September 14,2019 11:00 a.m.— 10:fl0 p.m. Section 2.That those portions of public rights-of-way at,in,or on which the above named alcoholic liquor rnay be consumed,on the days and during the hours listed in Section 1 hereof,.are described as follows: Central Park North Park Street from Water Street to Franklin Street South Park Street from Water Street to Franklin Street Water Street ftom Main Street to William Street Prairie Street from Alley to Water Street Seetion 3.That no alcoholic liquor may be consumed as provided herein unless such alcoholic liquar is in a plastic cup,paper cup or aluminum can. Section 4.That this ordinance is expressly conditioned and approved upon Decatur Smokin' BBQ Festival providing to the City of Decatur an agreement which will hold the City harmless for any and all damages incurred by persons attending this event and indemnifying the City for any and all damages and lawsuits.
