ORDINANCE NQ.��f-`€�`�JtP ORDINANCE AMENDING CITY CODE -CHAPTER 73— -OFFENSES— BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That Chapter 73 of the City Code af the City of Decatur, I1linois, be, and the sarne is hereby madified and arnended by amending language to Sectians 24 and 25, reflecting the amendment. Said Sectians 24 and 25 as so modified and amended, sha11 provide as follaws: 24. POSSESSIONICONSUMPTION CANIYASIS. A. It sha11 be unlawful for a persan to possess thirty (34} grams or less af any substance containing cannabis. This subsectian 24(A) shall be repealed on January l, 2020. B. DEFINITIONS. 1. Far purposes af this Section, cannabis includes rnarijuana,hashish and other substances which are identified as including any parts of the plant Cannabis Sativa and including derivatives or subspecies, such as indica,of all strains af cannabis , whether growing or not;the seeds thereof;the resin extracted frorn any part of such plant; and any compound, manufacture, salt,derivative,mixture or preparatian of the plant, its seeds, or resin, including tetrohydrocannabinol (THC) and all other cannabinal derivatives, including its naturally occurring ar synthetically praduced ingredients,whether produced directly or indirectly by extraction,or independently by means of chemical synthesis or by a combination of extraction and chernical synthesis; but shail not include the mature stalks of such plant, fiber produced from such stalks, oil or cake rnade frorn the seeds of such plant, any ather compound, rnanufacture, salt, derivative,mixture ar preparation of such mature stalks (except the resin extracted there frorn), fiber, oil ar cake, or the sterilized seed of such plant which is incapable of germination. Cannabis does nat include industrial hemp as defined and authorized under the I1linois Industrial Hernp Act. Cannabis also means concentrate and cannabis- infused products. 2. For purpases of this Section,pub�ic place means any place where a person could r0asonably be expected to be observed by others, including but not limited to al1 parts of buildings owned in whole ar in part, or leased, by the State or unit of local gavernment and all areas in a park, recreation area,wildlife area, or playground owned in whale or in part, leased,or managed by the 5tate or unit of local government. Public place does not include a private residence unless the private residence is used ta provide licensed child care, faster care, ar other similar sacial service care on the premises but does include retail tobacco stores.
