CITY OF DECATUR <br /> Section No.: 09-00933-01-BR <br /> Project No.: 3ELT(222) <br /> Job No.: C-97-106-21 <br /> RESOLUTION NO. 0 <br /> RESOLUTION AUTHORIZING LOCAL AGENCY AGREEMENT FOR <br /> FEDERAL PARTICIPATION WITH THE STATE OF ILLINOIS FOR THE <br /> BRUSH COLLEGE/FARIES PARKWAY GRADE SEPARATION <br /> CITY PROJECT 2009-33 <br /> SECTION 09-00933-01-BR <br /> WHEREAS,the City of Decatur endeavors to improve a segment of Brush College Road by <br /> construction of a grade separation at Faries Parkway and the Norfolk Southern Railroad,that is <br /> approximately 0.01 miles in length and known to the Illinois Department of Transportation as MFT <br /> Section Number 09-00933-01-BR and State Job Number C-97-106-21. <br /> WHEREAS,the cost of said improvement has necessitated the use of Federal funds,and; <br /> WHEREAS,the Federal fund source requires a match of State and Local funds,and; <br /> WHEREAS,the use of Federal funds requires a Local Agency Agreement for Federal <br /> Participation with the State of Illinois Department of Transportation,hereto attached as Exhibit A. <br /> NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR,ILLINOIS: <br /> Section 1. That the City Council of the City of Decatur, Illinois hereby appropriates the sum <br /> of Three Million,Nine Hundred Sixteen Thousand,Four Hundred Thirty-Six Dollars <br /> ($3,916,436.00)or so much thereof as may be necessary, from any money now or hereafter allotted <br /> to the City of Decatur, including State Motor Fuel Tax funds,to pay its share of the cost of the <br /> aforementioned project known as Section Number 09-00933-01-BR and State Job Number C-97-106- <br /> 21. <br /> Section 2. That only those streets,highways;and operations as listed and described as part of <br /> the Brush College Road/Faries Parkway Grade Separation Project,are eligible for State Motor Fuel <br /> Tax funds and shall be designated as Section 09-00933-01-BR. <br /> Section 3.That the City of Decatur agrees to pass a supplemental resolution to provide any <br /> necessary funds for its share of the cost of this improvemenrif the amount appropriated herein proves <br /> to be sufficient to cover said cost. <br /> Section 4. That the Mayor and City Clerk be,and they are hereby,authorized and directed to <br /> execute the above-mentioned Local Public Agency Agreement for Federal Participation and any <br /> other such documents related to the advancement and completion of said project,hereto attached as <br /> Exhibit A. <br /> PRESENTED and ADOPTED this 1801 day of January,2022. <br /> Page 35 of 163 <br />
