RESOLUTION NO.P U' a.L( 9 RESOLUTION AUTHORIZING AN AGREEMENT WITH THE STATE OF ILLINOIS FOR TRAFFIC SIGNAL MODERNIZATION OF WILLIAM STREET AT ITS INTERSECTION WITH COUNTRY CLUB ROAD BY MUNICIPALITY UNDER THE ILLINOIS HIGHWAY CODE CITY PROJECT 2021-04 SECTION NO. 21-00104-00-TL WHEREAS, the CITY OF DECATUR desires to enter into an AGREEMENT with the STATE OF ILLINOIS, acting by and through its DEPARTMENT OF TRANSPORTATION, for the traffic signal modernization of William Street (FAP 741) (IL 105) with Country Club Road(FAU 7452) in Decatur, and; WHEREAS, in compliance with the aforementioned AGREEMENT, it is necessary for the CITY of DECATUR to appropriate sufficient funds to pay its share of the cost of said improvement. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the Agreement between the City of Decatur and the State of Illinois, for the traffic signal modernization of William Street(FAP 741) (IL105)with Country Club Road (FAU 7452) is hereby, received and placed on file. Section 2. That the Mayor and City Clerk be, and they are hereby authorized and directed to execute an Agreement between the City of Decatur, Illinois, and the State of Illinois, acting through its Department of Transportation, attached hereto as Exhibit 1 and made a part hereof, in the amount of$36,000. Section 3. That the CITY OF DECATUR agrees to appropriate the sum of Thirty-Six Thousand Dollars ($36,000) or so much thereof as may be necessary, from any money now or hereafter allotted to the CITY OF DECATUR to pay its share of the cost of this improvement as provided in the Exhibit A of the AGREEMENT. Section 4. That upon award of the contract for this improvement,the CITY OF DECATUR will pay to the DEPARTMENT OF TRANSPORTATION of the STATE OF ILLINOIS, an amount equal to 50% of its obligation incurred under this AGREEMENT, and will pay to the said DEPARTMENT the remainder of the obligation(including any non-participating cost of the FA projects) in a lump sum,upon completion of the project based upon final costs. Section 5. That the CITY OF DECATUR agrees to pass a supplemental resolution to provide any necessary funds for its share of the cost of this improvement if the amount appropriated herein proves to be sufficient to cover said cost.
