RESOLUTION NO. 2023 R 51 RESOLUTION AUTHORIZING AGREEMENT WITH LOVE LEARNING AND LAUGHTER DAYCARE WHEREAS, City of Decatur, Illinois is an Illinois home rule community authorized to purchase, sell and otherwise engage in real estate exchanges; and, WHEREAS, the City of Decatur has or intends to purchase property located at 1170 Orchard Street, Decatur, IL; and, WHEREAS, the City has determined that additional childcare options are needed in the urban core based on the recently published workforce development systems assessment, strategy, and implementation roadmap; and, WHEREAS,the City has received Community Development Block Grant(CDBG-CV) funds to be utilized to prevent,prepare for, and respond to the coronavirus; and, WHEREAS,utilizing CDBG-CV funds for the purchase and renovation of structures to be used in the operation of childcare is an allowablel use of the funds; and, WHEREAS,Love Learning and Laughter Daycare ("LLLD")has been a State of Illinois Licensed childcare provider since January 24, 2019 ; and, WHEREAS,the City wishes to engage LLLD in utilizing such funds in accordance with HUD guidelines and Federal regulations to provide childcare services and has determined that LLLD has the capacity to own, manage and operate a new childcare facility. NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the City Manager or his designees are hereby authorized to negotiate an agreement with LLLD for the sale of 1170 Orchard Street, Decatur, IL to LLLD under the terms, conditions and instrument they determine to be in the best interest of the City. Section 2. That the City is authorized to negotiate the use of CDBG-CV authorized funds in the agreement entered into with LLLD. Section 3. That the City Manager or his designee is hereby authorized to enter into an agreement with LLLD for the sale of 1170 Orchard Street under the terms negotiated.
