ORDINANCE NO.ao Aq-Q C <br /> ORDINANCE AUTHORIZING ACCEPTANCE OF CERTAIN PROPERTY OF <br /> DECATUR PUBLIC SCHOOLS,DISTRICT 61 FOR PUBLIC PURPOSE <br /> WHEREAS, the City of Decatur, Illinois ("City") and the Decatur Public School District <br /> No. 61 ("District") are units of local government as defined by Article VII, Section 1, of the <br /> Constitution of the State of Illinois; and, <br /> WHEREAS, the City and District are authorized and empowered by Article VII, Section <br /> 10 of the Constitution and the Intergovernmental Cooperation Act(5 ILCS 220/1 et. seq.)to enter <br /> into Intergovernmental Agreements; and, <br /> WHEREAS, the City and the District have entered into an Intergovernmental Agreement <br /> attached hereto as Exhibit A and incorporated herein by reference, authorizing the transfer of <br /> property owned by the District ; and, <br /> WHEREAS, the District owns tracts of real estate, generally described as 1077 W. Grand <br /> Street, Decatur, Illinois as shown on the map attached in Exhibit A, and more particularly <br /> described as follows: <br /> The West 1/2 of the SW 1/4 (Exc. The North 30 feet for Street and W 30 feet for Street) of <br /> Lots 3 & 4; A tract measuring 611. 7 feet X 610. 83 feet. PIN Number 04- 12- 10- 301- <br /> 001. Situated in Macon County, Illinois. Premises"), <br /> on which is located a former school building,school site and adjoining green space,last commonly <br /> known and used as an elementary school that has been permanently removed from the District' s <br /> building inventory(hereinafter" Property"); and, <br /> WHEREAS the City desires to improve, revitalize and redevelop its neighborhoods and <br /> community and has determined that the property owned by the District is an important portion of <br /> said improvement, revitalization and redevelopment with the goal to return the properties and <br /> parcels owned by the District to the tax rolls thus increasing the tax revenues for the City, District <br /> and various taxing districts. <br /> NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1. That the City declares that it is necessary and convenient for it to use, occupy <br /> and/or improve the property owned by the District as more particularly set out in Exhibit A for the <br /> making of public improvements and for the public purpose of improving, revitalizing and <br /> redeveloping the City. <br />
