RESOLUTION NO. P-226 44 <br /> RESOLUTION AUTHORIZING A THIRD AMENDMENT <br /> TO INTERGOVERNMENTAL COOPERATION AGREEMENT WITH DECATUR <br /> METROPOLITAN EXPOSITION,AUDITORIUM AND OFFICE BUILDING <br /> AUTHORITY REGARDING SOLAR CANOPY PROJECTS <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DECATUR, <br /> ILLINOIS: <br /> WHEREAS, the City of Decatur, an Illinois home rule municipal corporation ("City") <br /> entered into an Intergovernmental Cooperation Agreement ("Agreement") with the Decatur <br /> Metropolitan Exposition, Auditorium and Office Building Authority ("Civic Center") dated <br /> November 24, 1980 for the purpose of setting forth the use and occupancy by the City of a <br /> portion of the Civic Center facilities including the use and occupancy of the parking lot area of <br /> the Civic Center; and, <br /> WHEREAS, the Agreement was amended in or around January 2012 regarding the <br /> parking lot area of the Civic Center; and, <br /> WHEREAS, the Agreement was amended in October 2022 authorizing the use of the <br /> parking lot area of the Civic Center to be used for a solar canopy project ("Project"); and, <br /> WHEREAS, the City has entered into a Power Purchase Agreement("PPA")with <br /> Hawk-Attollo ("Seller") for the construction of the Project in an effort to reduce energy costs for <br /> the City and the Civic Center; and, <br /> WHEREAS, the Seller has requested to sell the Project to another party and the City has <br /> requested additional solar projects be built on the parking lot area; <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Decatur as <br /> follows: <br /> Section 1. That the Third Amendment to the Civic Center IGA as attached, and the same <br /> is hereby, received,placed on file, and approved. <br /> Section 2. That the Mayor and City Clerk are authorized to execute the attached Third <br /> Amendment as attached here. <br /> PRESENTED and ADOPTED this I day of 2024. <br /> , <br />
