RESOLUTION NO. R2026-2o <br /> RESOLUTION AMENDING RESOLUTION 2023-08 AND THE PURCHASE AND <br /> RENOVATION AGREEMENT WITH DOVE,INC FOR THE PROPERTY LOCATED <br /> AT 805 E. JOHNS AVE. <br /> WHEREAS, on April 17, 2023,the City Council of the City of Decatur adopted <br /> Resolution No. 2023-08 approving a Purchase and Renovation Agreement with DOVE, Inc. for <br /> the property commonly known as 805 E. Johns Avenue,Decatur, Illinois; and, <br /> WHEREAS, the original agreement contemplated the sale of the property to DOVE, Inc. <br /> for$190,000, along with the provision of HOME-ARP funds for renovation; and, <br /> WHEREAS,the City has since acquired the property using HOME Investment <br /> Partnerships Program American Rescue Plan (HOME-ARP) funds; and, <br /> WHEREAS, the City Council finds that conveying the property to DOVE, Inc. for <br /> nominal consideration will further the purposes of the HOME-ARP program by supporting <br /> permanent supportive housing and advancing HUD's goals of reducing homelessness and <br /> housing instability; and, <br /> WHEREAS, all affordability, compliance, and enforcement provisions required under <br /> HOME-ARP and HUD regulations shall remain in full force and effect. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1. Resolution No. 2023-08 is hereby amended to remove the requirement that <br /> DOVE, Inc. pay$190,000 for the purchase of the property located at 805 E. Johns Avenue. <br /> Section 2. The City of Decatur is authorized to convey the property located at 805 E.Johns <br /> Avenue,Decatur,Illinois, legally described as: Lot Four(4)in Block Two(2)of William Martin's <br /> 2nd Addition of Out Lots to Decatur, as per Plat recorded in Book 17 on Page 364 of the Records <br /> of the Recorder's Office of Macon County, Illinois, to DOVE, Inc. for nominal consideration of <br /> Ten Dollars ($10.00). <br /> Section 3. All other terms and conditions of the Purchase and Renovation Agreement, <br /> including but not limited to affordability periods, deed restrictions, use limitations, compliance <br /> with HUD regulations, and enforcement provisions, shall remain unchanged and in full force and <br /> effect. <br />
