ORDINANCE NO. 2014-55 <br /> ORDINANCE AMENDING CITY CODE <br /> - CHAPTER 34 — TRAFFIC - <br /> - CHAPTER 73 - OFFENSES - <br /> BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, <br /> ILLINOIS: <br /> Section 1. That Sections 37(J) and 38(B) of Chapter 34 of the City Code of <br /> the City of Decatur, Illinois, be, and the same are hereby, modified and amended so <br /> that said Sections 37(J) and 38(B) shall provide as follows: <br /> CHAPTER 34, SECTION 37(J) <br /> 37. REMOVAL OF VEHICLES. Police officers are hereby authorized to <br /> remove or cause to be removed a vehicle from a public street or highway to the <br /> nearest garage, impound lot or other place of safety, or to a location designated by <br /> the Police Chief, under the following circumstances: <br /> J. When a sound amplification system in any vehicle has been used <br /> in violation of Section 10 of Chapter 73 of the City Code and the vehicle <br /> owner has received a prior written warning for a violation of this Section. No <br /> vehicle shall be impounded unless the owner received a prior written warning <br /> for operating a vehicle in violation of Section 10 of Chapter 73 or for owning <br /> any vehicle used in violation of the provisions of this Section. <br /> CHAPTER 34, SECTION 38(B) <br /> B. The provisions of this subsection shall be applicable to vehicles <br /> removed pursuant to Sections 37(J) through 37(V) inclusive of this Chapter: <br /> Section 2. That Section 10 of Chapter 73 of the City Code of the City of <br /> Decatur, Illinois, be, and the same is hereby, modified and amended so that said <br /> Section 10 shall provide as follows: <br /> CHAPTER 73, SECTION 10. NOISE ON PUBLIC STREET <br /> A. No driver of any motor vehicle within the City of Decatur shall operate <br /> or permit operation of any sound amplification system which can be heard <br /> outside the vehicle from seventy five (75) or more feet when the vehicle is being <br /> operated upon a street, highway or roadway unless such 'system is being <br /> operated to request assistance or warn of a hazardous situation. This section <br /> does not apply to authorized emergency vehicles. (Amended, Ordinance No. <br /> 2003-56, September 15, 2003) <br />
