ORDINANCE NO. 2012-47 ORDINANCE GRANTING WIND ENERGY SYSTEM PERMIT - 2410 WEST MOUND ROAD - t WHEREAS h on the 5 day of July, 2012 upon due notice, the Decatur City Plan Commission held a public hearing upon the petition of Cliff Maske, for a Wind Energy System permit under the provisions of Section XXXV of the Zoning Ordinance to allow a wind energy system on property located in the City of Decatur, Illinois and legally described as follows: Lot One (1) of Maske's 2nd Addition, as per Plat recorded in Book 5000, Page 121 of the Records in the Recorder's Office of Macon County, Illinois. Situated in Macon County, Illinois; and, WHEREAS, said Decatur City Plan Commission recommended that such wind energy system permit be approved. NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the recommendation and report of the Decatur City Plan Commission be, and the same are hereby, received, placed on file and granted. Section 2. That a wind energy system permit be, and it is hereby, granted to allow a wind energy system upon the premises aforesaid in accordance with the plat thereof hereto attached marked Exhibit A and hereby made a part hereof. Section 3. That the wind energy system permit be, and the same is hereby, expressly conditioned as follows: A. Proof of homeowner's insurance to cover the requirements of Section XXXV.B.16 will be required prior to building permits being issued. Section 4. That said wind energy system permit granted hereby, be, and it is hereby, made subject to the applicable provisions and requirements of Ordinance No. 3512, as amended, the same being the Zoning Ordinance of the City of Decatur, Illinois, and that the Zoning Map of said City be amended to show the granting and existence of this wind energy system permit.
