ORDINANCE NO. 2012-37 ORDINANCE GRANTING CONDITIONAL USE PERMIT - 1976 EAST DECATUR STREET - WHEREAS, on the 7th day of June, 2012, upon due notice, the Decatur City Plan Commission held a public hearing upon the petition of Jamie Henry for a conditional use permit under the provisions of Section XXII.A.2 of the Zoning Ordinance to allow the operation of a Day Care Home, Large in a R-3 Single Family Residence District on property located in the City of Decatur, Illinois and legally described as follows: Lot Twenty-Two (22) in Block Six (6) of Terrace Gardens Addition to the City of Decatur, as per Plat recorded in Book 300, Page 83 of the records in the Recorder's Office, Macon County, Illinois; and, WHEREAS, said Decatur City Plan Commission recommended that such conditional use permit be approved. NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the recommendation and report of the Decatur City Plan Commission be, and the same are hereby, received, placed on file and granted. Section 2. That upon the conditions set forth below a conditional use permit be, and it is hereby, granted to Jamie Henry and only to Jamie Henry to allow the operation of a Day Care Home, Large in the R-3 Single Family Residence District upon the premises aforesaid in accordance with the plat thereof hereto attached marked Exhibit A and hereby made a part hereof: 1. That the proposed operation be limited to a maximum of eight(8) children, 2. That the proposed operation be in compliance with applicable provisions of the City's adopted Building Codes, including obtaining a building permit to perform any proposed or required improvements to the existing dwelling, 3. That the proposed daycare be at all times appropriately licensed by the State of Illinois and a copy of that license, upon approval, will need to be filed with the Department of Planning and Building Services and, 4. The State Fire Marshall shall be contacted regarding a field inspection and a copy of the fire inspection report, upon completion, will need to be filed with the Fire Department.
