Caton, Recorder _\ <br /> Book: 4163 Page: 253 <br /> 1820519 R:csipt •: 41604 Recording Fee: 130.00 <br /> Pages Recorded:5; Authorized By k4alp.get. <br /> Date Recorded: 9/6/2011 8:26:41 AM <br /> 111111111111111IIII1111111111III1IIII11111111111111III11111111111111111111111111111 <br /> ORDINANCE NO. 2011-48 <br /> ORDINANCE VACATING PORTION OF STREET <br /> - A PORTION OF 1700 BLOCK BOB-O-LINK DRIVE — <br /> WHEREAS, a request has been received from Larry Rogers, requesting the vacation by <br /> the City Council of a portion of 1700 Block Bob-O-Link Drive, Illinois legally described as: <br /> Vacation of a portion of right-of-way on Bob-O-Link Drive, more particularly <br /> described as follows: Beginning at the Southeast Corner of Lot 49 of Fairway <br /> Estates as Recorded in Book 300 Page 377 of the Records in the Recorder's <br /> Office of Macon County in the State of Illinois; thence Northeasterly along the <br /> Southerly lot line of said Lot 49, also known as the Northerly right of way line of <br /> Bob-O-Link Drive a distance of 90 feet to a point; thence at right angles a <br /> distance of 60 feet to a point on the Northerly line of Lot 75 of Fairway Estates, <br /> said point also known as the Southerly right of way line of said Bob-O-Link <br /> Drive; thence Southwesterly a distance of 90 feet to the Northwest Corner of said <br /> Lot 75; thence Northwesterly a distance of 60 feet to the point of beginning; and, <br /> WHEREAS, said portion of said street is no longer useful to the public or to the City or <br /> to the owner of the property abutting thereon as right-of-way; and, <br /> WHEREAS, the public interest will be subserved by vacating said portion of said street <br /> and the public will be relieved from the further burden and responsibility of maintaining the <br /> same. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That upon the condition set forth below, the above described portion of street <br /> be, and the same is hereby, vacated as a public street inasmuch as the same is no longer required <br /> for public use and the public interest will be subserved by such vacation, said portion of said <br /> street being shown on the plat thereof hereto attached and hereby made a part hereof. <br /> A. A ten (10) foot ingress/egress easement will be required along the <br /> southeasterly line of Lot Forty-Nine (49) of Fairway Estates, as per Plat recorded <br />
