Eaton, Recorder Book: 4020 Page: 12 Receipt e: 26202 Recording Fee: 130.00 Pages Recorded: 3 Authorized By:�,yya,,,n 1'782688 �£r e Recorded: 9/22/2009 11:50:54 AM 1111111 Hill 1111111111111 Hill I Hill 11111 Hill 111111111111 Hill IIIII Hill 1111111111111111111111 ORDINANCE NO. 2009-66 ORDINANCE VACATING ALLEY - 1200 BLOCK WEST ELDORADO STREET - WHEREAS, a request has been received from Cedarwood Development requesting the vacation by the City Council of an alley in the City of Decatur, Illinois legally described as: The Sixteen (16) foot wide alleyway located between North Fairview Avenue (IL S.R. 48) and U.S. Route 36; North of and adjacent to Lots Eleven (11) thru Twenty (20), Block 4, Fairview Addition as per Plat recorded in Book 149, Page 421 in the records of the Recorder's Office of Macon County, Illinois; and, WHEREAS, said alley is no longer useful to the public or to the City or to the owner of the property abutting thereon as an alley; and, WHEREAS, the public interest will be subserved by vacating said alley and the public will be relieved from the further burden and responsibility of maintaining the same. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the above described alley be, and the same is hereby, vacated inasmuch as the same is no longer required for public use and the public interest will be subserved by such vacation, said alley being shown on the plat thereof hereto attached and hereby made a part hereof. Section 2. The permanent index number of the property acquiring title to the property vacated hereby is 04-12-16-228-002. PRESENTED, PASSED, APPROVED AN RECOR . ED this 21st day f September, 2009.
