s ORDINANCE NO. 2008-61 ORDINANCE AMENDING RESIDENCE DEVELOP ENT PLAN - 3077 SOUTHERN HILLS DRIVE - WHEREAS, on 7th day of August, 2008, upon due notice, the Decatur City Plan Commission held a public hearing upon the petition of Decatur Proper�ties of Illinois — Southern Hills/Orlando Apartments to modify and amend the R-5 Residence DeVelopment Plan previously approved by Ordinance No. 79-93, on premises situated in the Cityl of Decatur, Illinois, and legally described as follows: The East Ten (10) acres of the West Fifteen (15) acres of the South Thirty (30) acres of the Southwest Quarter ('/4) of the Southwest Quarter ('/4) of Section 34, i Township 17 North Range 2 East of the Third Principal Meridian in the City of Decatur, Illinois, excepting therefrom the East Thirty (30) feet of the South 500 , feet of the above described parcel; and, WHEREAS, the Decatur City Plan Commission did report its findings and did recommend that the modification of said R-5 Residence Development Plan as requested be authorized. NOW, THEREFORE, BE IT ORDAINED, BY THE CITY C�OUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the report and recommendation of the Decatur City Plan Commission be, and the same is hereby, received, placed on file and approved. Section 2. That the aforesaid R-5 Residence Development �'lan be, and the same is hereby, modified and amended, to allow a six (6) foot high fence on Iqt lines, and petitioner be, and it is hereby, authorized and permitted to construct and maintain a six (6) foot high fence on the perimeter of the property.
