ORDINANCE NO. 99-95 ORDINANCE REVERSING A DECISION OF THE ZOIVING BOARD OF APPEALS - 3770 RICHLAND DRIVE - WHEREAS, on September 9, 1999, pursuant to notice as required by statute, the Decatur Zoning Board of Appeals held a public hearing upon the petition of Christian Sassano and Shelley Sassano for a variation in the minimum required R-3 front yard setback along Sunnyside Road from the permitted twenty five (25) feet to the requested six (6) feet, for the premises legally described as follows: Lot Eighteen(18) of Richland Heights 1 st Addition as per Plat recorded in Book 1832 Page 87 of the records in the Recorder's Office of Macon County, Illinois; and, WHEREAS, after due consideration and upon an affirmative vote of less than five (5) members thereof, said Zoning Board of Appeals did approve the prayer of said petition and did vary the provisions of said Zoning Ordinance as requested; and, WHEREAS, Delores J. Reed and others, have timely filed an appeal of said Board decision with the City Clerk, pursuant to Section XXIII(D) of the Zoning Ordinance, seeking reversal of said decision and a denial of said request for variance.
