r <br /> ORDINANCE NO, 99-84 <br /> ORDINANCE AUTHORIZING <br /> DESIGNATION OF CITY AS <br /> PRIMARY RESCUE/RESPONSE PROVIDER <br /> WHEREAS, in the Memorandum of Understanding approved by this Council by <br /> Resolution No. R98-48 ("Memorandum"), the City agreed to provide written confirmation of the <br /> City's willingness to be designated as the primary provider for hazardous response, confined <br /> space and trench rescue services for the entities which were parties to said Memorandum, upon <br /> receipt by the City of the financial and in-kind contributions specified therein; and, <br /> WHEREAS, in the judgment of Council, sufficient financial and in-kind contributions <br /> have been pledged by the parties to said Memorandum to meet the spirit and intent thereof, and <br /> the City should therefore provide to said parties said written confirmation, on the conditions set <br /> out herein. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS. <br /> Section 1. That the City Manager and the Fire Chief be, and they are hereby, authorized <br /> and directed to provide to the parties to the Memorandum such written confirmation regarding <br /> the provision of various safety and rescue services as is called for therein, on the conditions set <br /> out below and as approved by the City's Corporation Counsel. <br /> Section 2. That the written confirmation referred to in Section 1 hereof shall be provided <br /> as specified therein, stating that the City shall perform the described safety and rescue services <br /> for the parties to said Memorandum,but only for that period of time corresponding to the amount <br /> actually deposited with the City by said parties, as follows: <br /> $250,000 One (1) year of service <br /> next $150,000 One (1) additional year of service <br /> final $100,000 One(1) final year of service <br /> If the total amount due for all three (3) years is not paid prior to the issuance of the first written <br /> confirmation, additional confirmations will be issued as each funding increment is deposited. <br /> The first written confirmation will be effective sixty(60) days after the first funding increment is <br /> deposited and all safety and rescue information requested by the Fire Chief from each party is <br /> received by the City. <br />
