. � <br /> ORDINANCE NO. 98- 78 <br /> AN 01��1v.�NCE authorizing and approving amendments to <br /> certain financial covenants of Millikin University, an Illinois not <br /> for profit corporation (the "Corporation"), relating to the issuance <br /> of additional indebtedness contained in the Loan Agreement, <br /> Mortgage and Security Agreement dated as of August 1, 1993 (the <br /> "Original Series 1993 Mortgage") between the City of Decatur, <br /> Macon County, Illinois (the "City") and the Corporation executed <br /> and delivered in connection with the issuance by the City of its <br /> City of Decatur, Macon County, Illinois Revenue Refunding <br /> Bonds, Millikin University, Series 1993 (the "Series 1993 <br /> Bonds"); authorizing and approving the execution and delivery of <br /> a First Supplemental Trust Indenture dated as of December 1, 1998 <br /> between the City and National City Bank of Michigan/Illinois <br /> (formerly known as First of America Trust Company), as trustee <br /> (the "Series 1993 Trustee"), supplementing the Trust Indenture <br /> dated as of August 1, 1993 between the City and the Series 1993 <br /> Trustee and securing the Series 1993 Bonds; authorizing and <br /> approving the execution and delivery of a First Supplemental Loan <br /> Agreement, Mortgage and Security Agreement dated as of <br /> December 1, 1998 (the "First Supplemental Mortgage") between <br /> the City and the Corporation, supplementing the Original Series <br /> 1993 Mortgage; and authorizing and approving certain related <br /> matters. <br /> WHEREAS, the City of Decatur, Macon County, Illinois (the "City"), is a duly constituted <br /> and existing municipality and a home rule unit within the meaning of Section 6(a), Article VII of <br /> the 1970 Constitution of the State of Illinois; and <br /> . <br /> WHEREAS, the City, pursuant to its powers as a home rule unit, is authorized and <br /> empowered to issue its revenue bonds to finance and refinance the costs of acquiring, <br /> constructing, renovating and equipping educational facilities for private, nonprofit institutions of <br /> higher education located within the City in order to enhance the general health and welfare of the <br /> residents of the Ciry and the surrounding areas; and <br /> 847870.01.O1.B <br /> 1114230 <br />
