O � � / =�:r� ^r , _ I! <br /> �x�Wt`��r•f����r, ,i <br /> ORDINANCE AMENDING ZONING ORDINANCE <br /> - RESIDENTIAL CARE FACILITIES - <br /> WHEREAS, after due notice, the Decatur City. Plan Commission <br /> held a public hearing on the lst day of September, 1988 , upon the <br /> petition of Macon Resources, Inc. to modify and amend the Zoning <br /> Ordinance of the City of Decatur, the same being Ordinance No. <br /> 3512, as amended, at Section XXI .A. 1 . (t) (1) - (3) thereto <br /> regarding residential care facilities; and, <br /> WHEREAS, said Decatur City Plan Commission did report its <br /> finding and did recommend that the prayer of said petition be <br /> granted and the Zoning Ordinance be so modified and amended. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1. That the report and recommendation of the <br /> Decatur City Plan Commission be, and the same are hereby, <br /> received, placed on file and approved. <br /> Section 2 . That the Zonin Ordinance of the Cit of Decatur <br /> g Y <br /> be, and the same is hereby, modified and amended at Sections <br /> XXI .A. 1 . (t) (1) - (3) thereof so that as so modified and amended <br /> said Sections XXI .A. 1 . (t) (1) - (3) of said Zoning Ordinance <br /> provide as follows: <br /> (1) Facilities of more than 16 beds in the R-5 or R-6 <br /> zoning districts, provided that such a facility is not <br /> located within 1/2 mile of any other residential care <br /> facility as measured from the nearest points on the <br /> respective lot lines, and further provided that such <br /> facility be located on a site containing a lot area of <br /> at least 1/2 acre plus an additional 500 square feet for <br /> each bed. <br /> (2) Facilities of not more than 16 beds in the R-5 or <br /> R-6 zoning districts, provided that such a facility is <br /> not located within 1/2 mile of any residential care <br /> facility of not more than 16 beds, as measured from the <br /> nearest points on the respective lot lines, and further <br /> provided that such a facility be located on a site <br /> containing the minimum lot area of the zoning district <br /> in which it is located plus an additional 500 square <br /> feet for each bed. <br />
