' �' � i. <br /> �� � � MICROFILI� <br /> ORDINANCE N0. 87-73 <br /> ORDINANCE VACATING PORTION OF STREET <br /> DIPPER LANE <br /> SANITARY DISTRICT OF DECATUR <br /> WHEREAS, a petition has been received from the Sanitary <br /> District of Decatur, being the owner of all property abutting <br /> thereon, requesting vacation of a portion of that certain street <br /> in the City of Decatur, Illinois , commonly known as Dipper Lane <br /> said portion of said street being more particularly described as : <br /> SEE EXHIBIT A ATTACHED HERETO AND HEREBY <br /> MADE A PART HEREOF <br /> WHEREAS, the Decatur City Plan Commission held a public <br /> hearing upon said petition on April 2 , 1987 and did thereafter <br /> recommend to the Council that the prayer of said petition be <br /> granted and said portion of said street be vacated as requested; <br /> and. <br />' WHEREAS, said portion of said street is no longer useful to <br /> the public or to the City or to the owners of property abutting <br /> thereon and the public interest will be subserved by vacating <br /> said portion of said street and the public will be relieved from <br /> any further burden or responsibility for the opening, improving <br /> or maintaining said portion of said street . <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS : <br /> Section 1. That the above described portion of said Dipper <br /> Lane be, and the same is hereby, vacated as a public street upon <br /> the exceptions and conditions hereinafter provided inasmuch as <br /> the same is no longer required for public use and the public <br /> interest will be subserved by such vacation, said portion of said <br /> street being shown on the plat thereof hereto attached and hereby <br /> made a part hereof. <br /> Section 2 . That there is hereby reserved in, over, along <br /> and under the above described portion of said street and alley, I <br /> to the City of Decatur, Illinois , and to the public and to those � <br /> utilities and companies as the case may be ov,�ning public service I <br />
