' • , ' P ' MtCRO��Q ORD INANCE N0. �— � l-� �— ORDINANCE AMENDING ZONING ORDINANCE - SPECIAL USE PERMITS - WHEREAS , on the 2nd day of October, and the 5th day of November , 198b , upon due notice , the Decatur City Plan Commission held public hearings on the petition of the Director of Community Development to modify and amend the special use regulations of the Zoning Ordinance , the same being Ordinance No. 3512 , as amended, at Section XXI .A. l and XXI .A. 3 thereof so as to authorize the Council to vary from the requirements of a specific zoning district when issuing such permits , provided the essential character and nature of the neighborhood are unchanged, and to authorize the Council to grant such permits by majority vote ; and, WHEREAS , the Decatur City Plan Commission did recommend that the prayer of said petition be granted and said special use regulations �e so modified and amended. NOW, THEREFORE , BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS : Section 1 . That the recommendation of the Decatur City Plan Commission be , and the same is hereby, received, placed on file and approved. Section 2 . That that portion of Section XXI .A. 1 preceding subsection (a) thereof and Section XXI .A. 3 of the Zoning Ordinance be , and the same are hereby, modified and amended so that as so modified and amended said sections provide as follows : XXI .A. 1 . The City Council may by Ordinance grant a special use permit only for the following special uses in any district , except as herein qualified , from which they are otherwise prohibited by this Ordinance , and may vary the application of otherwise applicable regulations for such special uses , provided that the essential character and nature of the surrounding neighborhood are not disturbed , and may also impose appropriate conditions and safeguards , including a
