S � ' <br /> , ' <br /> � MED <br /> ORDINANCE NO . 0 ' 7� <br /> ORDINANCE VACATING A PORTION OF A STREET ' <br /> ROAD ONE <br /> WHEREAS , a request has been received from The Citizens <br /> National Bank of Decatur , as Trustee under the provisions of <br /> a trust agreement dated the 23rd day of February, 1983 , <br /> known as Trust Number 3118, the owner of property abutting <br /> thereon requesting vacation of a portion of a street in the <br /> City of Decatur , Illinois , said portion of street commonly <br /> known as Road One and said portion of said street being more <br /> particularly described as : <br /> A portion of Road One in Block Six (6 ) of <br /> Southmoreland Place , an Addition recorded in Book <br /> 300 , Page 122 of the records in the Recorder ' s <br /> Office , Macon County, Illinois , more particularly <br /> described as follows : <br /> All of that part of Road One lying east of a line , <br /> said line extending northerly from a point on the <br /> South line of said Road One said point being 35 . 00 <br /> feet west of the Northwest corner of Lot 10 of <br /> Block 6 , Southmoreland Place , to a point on the <br /> North line of said Road One , said point being <br /> 43 . 50 feet east of the Southwest corner of Lot 5 <br /> of Block 6 , Southmoreland Place , containing 7 , 816 <br /> square feet more or less ; and, <br /> WHEREAS , said portion of said street is no longer <br /> useful to the public or to the City or to the owners of <br /> property abutting thereon and the public will be subserved <br /> by vacating said portion of said street and the public will <br /> be relieved from any further burden or responsibility for <br /> opening , improving or maintaining said portion of said <br /> street . <br /> NOW, THEREFORE , BE IT ORDAINED BY THE COUNCIL OF THE <br /> CITY OF DECATUR, ILLINOIS : <br /> Section l . That the above-described portion of said <br /> Road One be , and the same is hereby, vacated as a public <br /> street upon the exceptions and conditions hereinafter <br /> provided inasmuch as the same is no longer required for <br /> public use and the public interest will be subserved by such <br /> vacation, said portion of said street being shown on the <br /> plat thereof hereto attached and hereby made a part hereof . <br />
