1 � r�. �� ' °�� -�FlLMED • . ORDINANCE NO. � I- 1�� ORDINANCE VACATING A PORTION OF A STREET RIDGE AVENUE WHEREAS, a petition has been received from Albert H. Artze and Jessie M. Artze, the owners of property abutting thereon, requesting vacation of a portion of that certain street in the City of Decatur, Illinois, commonly known as Ridge Avenue, said portion of said street being more particularly described as : Beginning at the Southeast corner of Lot 44 of Lake Park Addition as per plat recorded in Book 536 page 105 of the records in the Recorder' s Office of Macon County, Ilinois; thence East 60 feet to the East right-of-way line of Ridge Avenue; thence Northerly along the East right-of-way line to the South right- - of-way line of East William Street; thence Westerly along the South right-of-way line of East William Street to the West right-of-way line of Ridge Avenue; thence Southerly along the West right=of-way line of Ridge Avenue to the point of beginning; and, WHEREAS, the Decatur City Plan Commission held a public hearing upon said petition on August 6 , 1981 and did thereafter recommend to the Council that the prayer of said petition be granted and said portion of said street be vacated as requested; and, WHEREAS , said portion of said street is no longer useful to the public or to the City or to the owners of property abutting thereon and the public interest will be subserved by vacating said portion of said street and the public will be relieved from any further burden or responsibility for opening, improving or maintaining said portion of said street; and, WHEREAS, Ordinance No. 81-105 previously passed by the Council purported to vacate said portion of Ridge Avenue but contained an incorrect legal description of same. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section l. That the above described portion of said Ridge Avenue be, and the same is hereby, vacated as a public street upon the exceptions and conditions hereinafter provided inasmuch as the same is no longer required for public use and the public interest will be subserved by such vacation, said portion of said street being shown on the plat thereof hereto attached and hereby made a part hereof.
