- ; ' � - � � ��ROFILMED � ORDINAiVCE NO . �� P� AN ORDINA:�CE V�C�TI�G � PORTI0�1 OF STREET :iILL PAP.K AVE?`1tJ� �VD HILL PARK D?IVE WHEREAS , petition has been received from Joy B . �znneCy and others who are o��rners of property abutting thereon, reguesting vacation by the Council of a portion oi certain streets in the City of Decatur, Illinois, commor.ly known as Hill Park A�nue and Hill Park Drive , said portion of said streets being Cescri�ed as follows : Beginning at the Northwest corner of Lot 12 of Hill Pzrk, Decatur, Illinois, as per plat recorded in Book 300 page 2E7 of the re�ords in the Recorder ' s Office of �Iacon County, Illinois ; thence South 418 . 01 feet along the west line o� Lots 12 and 11 of said Hill Park and said line extended South to t:�e South line of Hill Park Drive ; thence West along Hill Park Drive to the Northeast �tight-of-Way lir_e of the Illinois Central Gulf Railroad; thence Nort:�west 123 . 17 feet along said Right-of-Way line to the Southwest corner of LoL 14 of said :iill Park; thence East 56 . 75 fze� to t��e Southeast corner of said Lot 14 ; thence North 316 . 78 feet to the Northeast corner of Lot 13 of � said Hill Park; thence East 50 .00 feet to the place of beginning, and, WHEREAS, The Decatur City Plan Commission after public heari:�g, has recommended that the prayer of said petition be grant�d and said portion of said streets be vacated as requested; and, WHEREAS , said portion of said street althoLgh Nlatted as streets, have no� been improved or used as a street; and, Wi�REAS, said portion of said street is no longer useful to the pub.Lic or to the City or to the owners of property abutting thereon as streets; and, WI�iEREAS, the public interest will be subserved by vacating said portion of said streets and the public will be relieved from any future burden or responsibility for opening, improving, or maintaining the same as a street. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DEG�1iUR, ILLINOIS. Sect�on 1 . That the above described pert�on �f Hill Park Avenue and Hill Park Drive be , and the sarne is hereby, vacated as a public street or way effzctive ar.d upon t�e excep�iens ard. conditions hereinafter provided, inasmuch as the same are no longer required for public use as a street and the public interest w�ll be s�served by such vacation, said portion of said streets beir.g shown an the plat thereof hereto attached and he=eby made a part hereof.
