. � <br /> < �� � <br /> . • � � . . � � .�'�1�ROf1LMEp <br /> ORDINANCE NO. ��� <br /> ORDINANCE VACATING A PORTION OF STREET <br /> NORTH SUMMIT AVENUE <br /> WHEREAS, by intergovernmental cooperation between the Highway <br /> Commissioner of the Town of Decatur Road District and the City, Twin <br /> Bridge Road, commonly known as North Summit Avenue, has been heretofore <br /> relocated and a new road and bridge constructed and the heretofore <br /> existing road has been closed off and the use thereof as a road or <br /> hig�way abandoned; and, <br /> WHEREAS, after a public hearing on February 24 , 1977 the older <br /> right of way of said road where the same extended in said road district <br /> and outside the corporate limits of the City was by said Highway <br /> Commissioner duly vacated; and, <br /> WHEREAS, that portion of said road or highway within the <br /> City limits has now become isolated by reason of the vacation of those <br /> portions thereof� at eithPr end of said portion within the City limits <br /> and the same is no longer accessible by or useful to the public or the <br /> abutting owners as a road or highway and the vacation thereof has been <br /> requested by the owners of all said abutting property; and, <br /> WHEREAS, the public interest will be subserved by vacating said <br /> portion of said� road or highway and the public will be relieved from <br /> any further burden or responsibility of opening or improving or maintaining <br /> the sam�. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1. That the hereinafter described portior_ of Twin Brid�e <br /> Road, commonly known as North Summit Avenue, within the city be, <br /> and the same is hereby, vacated as a public road, street or highway upon <br /> the condition hereafter provided inasmuch as the same is no langer <br /> required for nublic use and the public interests will be subser�ed hy <br /> such vacation, said portion of such road or highway being shown on 4he <br /> plat thereof hereto attached and hereby made a part hereof, the same being <br /> described as follows : <br /> A3.1 that part of Twin Bridge Road, now commonly <br /> known as North Summit Avenue within the corporate <br /> limits of the City, situated in the South 275 feet <br /> of the Northwest Quarter (NW�) of the Northwest <br /> Quarter (NW�,) of Section 4 , Township 15 North, <br /> Range 2 East of the 3rd P.M. <br /> Section 2 . That the benefits which will accrue to the owners of <br /> abutting prop�erty by reason of the vacation aforesaid is determined to be <br />
