. ,. .. - . , / V ORDINANCE NO.- > � / � AN ORDINANCE RE?ANING PAOPERTY WHEREAS, on the lst day of October, 1970, after notice as required by la w and ordinance, the Decatur City Plan Commission held a public hearing upon the petition of GARY HUt�-tES to rezone premises described as: A part of Lots 34 and 35 of Greenwich Gardens, as per P1at recorded in Book 802, page 72 of the Records in the Recorder's Office of Macon County, Illinois, de- scribed as follows: Beginning at a point 51 feet ea�t of the northwest corner of said Lot 34, thence east along the north boundary line of said Lots 34 and 35, � 197.9 feet to the westerly right-ofway line of S.B.I. Route 121, thence southwesterly along said right-of-way line 175 feet, thence west parallel with the north boun- dary line of said Lots 34 and 35 to a point 51 feet east of the w�est line of said Lot 34, thence north to the place of beginning, together with all rights, tit le and interest of the grantors in and to tha t part of Lot 35 lying within the limits of the right-of-way of S.B.I. Route 121 and adjoining the above described tract on the ea5t, subject to a right-of- way grant for highway purposes to the People of the State of Illinois recorded in Book 802, page 60 of the Records in the Recorder 's Office of Macon County, Illinois; from B-1 NEI6I�ORHOOD SHOPPING DISTRICT to B-2 COMN�RCIAL DISTRICT; and WHEREAS, the Decatur City Plan Commission recommended that the prayer of said petition be denied. NOW THEREFORE, BE IT ORDAINE D BY THE �UNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the recommendation of the Decatur City Plan Commission be, and the same is hereby, disapproved. Section 2. That said above described premises be, and the same are hereby, r�zoned from B-1 NEIGHBORHOOD SHOPPING DISTRICT to B-2 COM- NIERCIAL DISfiRICT. Section 3. That the Districts hereinabove me ntioned are those districts set forth and defined in Ordinance No. 3512 of the City of Decatur, Illinois, commonly known as the Zoning Ordinance, and all the provisions, regulat ions, restrictions and requirements therein set forth shall apply to the premises above described herein. Section 4. That the zoning of said premises shall be shown and verified on the District Zoning Map as in such Ordinance No. 3512 provided.
