. ,. .. - <br /> . , / <br /> V <br /> ORDINANCE NO.- > � / � <br /> AN ORDINANCE RE?ANING PAOPERTY <br /> WHEREAS, on the lst day of October, 1970, after notice as <br /> required by la w and ordinance, the Decatur City Plan Commission <br /> held a public hearing upon the petition of GARY HUt�-tES to rezone <br /> premises described as: <br /> A part of Lots 34 and 35 of Greenwich Gardens, as per <br /> P1at recorded in Book 802, page 72 of the Records in <br /> the Recorder's Office of Macon County, Illinois, de- <br /> scribed as follows: Beginning at a point 51 feet ea�t <br /> of the northwest corner of said Lot 34, thence east <br /> along the north boundary line of said Lots 34 and 35, <br /> � 197.9 feet to the westerly right-ofway line of S.B.I. <br /> Route 121, thence southwesterly along said right-of-way <br /> line 175 feet, thence west parallel with the north boun- <br /> dary line of said Lots 34 and 35 to a point 51 feet east <br /> of the w�est line of said Lot 34, thence north to the place <br /> of beginning, together with all rights, tit le and interest <br /> of the grantors in and to tha t part of Lot 35 lying within the <br /> limits of the right-of-way of S.B.I. Route 121 and adjoining <br /> the above described tract on the ea5t, subject to a right-of- <br /> way grant for highway purposes to the People of the State of <br /> Illinois recorded in Book 802, page 60 of the Records in the <br /> Recorder 's Office of Macon County, Illinois; <br /> from B-1 NEI6I�ORHOOD SHOPPING DISTRICT to B-2 COMN�RCIAL DISTRICT; <br /> and <br /> WHEREAS, the Decatur City Plan Commission recommended that the <br /> prayer of said petition be denied. <br /> NOW THEREFORE, BE IT ORDAINE D BY THE �UNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1. That the recommendation of the Decatur City Plan <br /> Commission be, and the same is hereby, disapproved. <br /> Section 2. That said above described premises be, and the same <br /> are hereby, r�zoned from B-1 NEIGHBORHOOD SHOPPING DISTRICT to B-2 COM- <br /> NIERCIAL DISfiRICT. <br /> Section 3. That the Districts hereinabove me ntioned are those <br /> districts set forth and defined in Ordinance No. 3512 of the City of <br /> Decatur, Illinois, commonly known as the Zoning Ordinance, and all the <br /> provisions, regulat ions, restrictions and requirements therein set forth <br /> shall apply to the premises above described herein. <br /> Section 4.
