I .. ,.. /. -t t � � ORDINANCE NO. ��/ I AN ORDINANCE VACATING A PORTION OF STREET -- SAMUELS STREET �na-iEREAS, a petition has been receivsd by the City from ARCHER, DANIELS, MIDLAND COMPANY, the ow�ner of all property a butting thereon except the South 726 feet of the west side thereof, requesting the vacation by the City Council of a por- tion of that certain street in the City of Decatur, Illinois, commonly known as North Samuels Street, said portion more par- ticularly described as: Commencing at the northwest co rner of the intersec- tion of East Division Street and existing North Samuels Street in the City of Decatur, Illinois, which point is the southeast oorner of Lot 9 of Race- I-and Plat C, an addition to the �=ity of Decatur, as per plat recorded in Book 335, page 194 of the Records in the Recorder's Office of Macon County, Illinois; thence north along the east line of said Lot 9 and the east line of Lot 4 of said Race-Land Plat C to the south line of East Faries Parkway; thence east 50 feet along the south line of said Faries parkway; thence south paral- lel to the east lines of said Lots 4 and 9 to the south line of Lot 10 of said Race-Land Plat C; thence west 50 feet to the place of beginning; and t+1HEREAS, there has been received by this Council the Agree- ment of QOODAI;.fi TRUST NO. 1, DATED MARCH 1, 1959, the owner of the premises abutting said South ?26 feet of said portion of said street by which agreement said Trust does undertake to support the petition aforesaid; and WHEREAS, petitioner has offered to relocate, construct and improve a new street more useful to the public and to dedicate right- of-way for the same over land owned by petitioner approximately 1,000 feet westerly from the current location of said street; and WHEREAS, said portion of said Samuels Street is poorly drained and maintained to the extent that the bituminous surface formerly existing thereon has disintegrated so that the same could be repaired or replaced only at considerable expense to the public; and t�IEREAS, the existing portion of said street is used almost ex- clusively by large trucks entering into and exiting from the process- ing plant of petitioner; and WI-iEF�AS, the relocation of said street will greatly relieve the traffic congestion currently existing on East Faries Parkway in the vicinity of said portion of said Samuels Street and will be condusive to greater traffic safety on said portion of said Faries Parkway for the benefit of persons using the same; and
