H ORDINANCE NO. r �� AN OR DI NANCE VACATI NG A PORTI ON OF STREET -- EAST WEBSTER COURT WHEREAS, a petition has been received by the City from I�YMAN, INC. , the owner of all property abutting thereon, re- questing the vacation by the City Council of a portion of that certain street in the City of DecatuY, Illinois, commonly known as East Webster CouYt, and a public walkway extending from the westerly end of said street westerly to South Broadway Street, • said portion of said street and said walkway being more par ticu- larly described as: Commencing at the southwest corner of Lot 10 in Cantrell Heights Subdivision, as per Plat recor- ded in Book 300, page 239 of the Records in the Recorder's Office of Macon County, Illinois; thence westerly along the south lines of Lots 12 and 14 of said Cantrell Heights Subdivision to the East right of way line of South Broadway Street; thence South along the East right of way line of South BYoadway Street, 5 feet to the north-- west corner of Lot 13 of said Cantrell Heights Sub- division; thence E asterly along the north line of said Lot 13 to the northeast corner thereof; thence southerly and easterly along the easterly and north- erly lines of Lots 13 and 11 of said Cantrell Heights Subdivision to the northwest corner of Lot 9 thereof; thence North to the place of beginning; and WHEREAS, said walkway and said portion of said stYeet is not now improved and has not for several years been used as a pub- lic stYeet or way and is no longer useful to the public or to the city or to the owners of property abutting thexeon as a street or a walkway; and WI-�REAS, the public interest will be subserved by vacat-- ing said portion of said street and walkway and the public will be relieved from any further burden or responsibility for opening said portion of said street or maintaining the same; and WHEREAS, there are no public service facilities thereon. NOW THEREFORE, BE IT ORDAINED BY 1HE CO[JNCIL OF THE CITY OF DECATUR� ILLINOIS: Section 1. That the above described portion of said street and walkway be, and the same is hereby, vacated as a public street and walkway inasmuch as the same is no longer required for public use as a stYeet and walkway and the public interest will be subserved by such vacation and the public will be relieved from any furtheY burden or re- sponsibility of opening said street or walkway or maintaining the same, said portion of said street and walkway being shown on the plat thereof hereto attached and hereby made a part hereof.
