marvbIlx M9:f- = i a. m
Excerpts from Plan Commission Meeting of September 7,2017:
Cal. No. 17-30 Petition of TKG'S WING HEAVEN, LLC, for a
Conditional Use Permit in the B-1 Neighborhood
Shopping District to allow for a drive through
facility located at 760 SOUTH FRANKLIN
STREET.
It was moved and seconded (Jeffery/Myatt)to remove Calendar No. 17-30 from the table.
Motion carried unanimously.
Ms. Stickle presented the recommendation of staff:
The subject site, located at 760 South Franklin Street, contains a 1,700 square foot commercial
structure housing a restaurant. The subject site is zoned B-1 Neighborhood Shopping District.
The subject petition requests a conditional use permit to allow for a drive through facility in the
B-1 Neighborhood Shopping District.
TKG'S Wing Heaven is a franchise that has been operating for a couple of years in Decatur and
has a new online ordering service where patrons can pay for their order and just stop by the
restaurant to pick up. The petitioner would like to convert an existing window into a drive
through pick up window so that patrons ordering online may have the option and convenience of
staying in their vehicles.
The petitioner is proposing to only have five (5) stacking spaces instead of the required ten (10)
stacking spaces as there will be no menu/order board on site.
Staff supports the proposed Conditional Use Permit, as the addition of a drive through facility will
help to expand the abilities of the business to better serve their patrons. Staff believes the proposed
reduction in stacking spaces to five (5) should not cause any issues with congestion as there will
be no menu/order board on site. Online orders will be placed and paid beforehand, and therefore
considerably reducing the amount of time a patron will have to wait in line in their vehicle.
According to Section XXII.A.3. there are three standards which must be met in order to grant a
conditional use permit. The first standard requires that the use be "necessary for the public
convenience at the location." The proposed use is generally compatible with the area along South
Franklin Street and the drive through facility will provide a service which can be utilized by
residents.
The proposed use also meets the second standard. The facility is located and designed to be
operated in a manner in which the public health, safety and welfare will be protected.
Last, the facility should not cause injury to the value of other properties in the area as stated by the
third standard. The addition of a drive through facility to the existing restaurant use should not
cause injury to the value of other properties in the area.
