Book: 4`54"u- Fame.: 346-
Excerpts from Plan Commission Meeting of September 7,2017:
Cal. No. 17-38 Petition of AD BINDER PLUMBING, to rezone
property located at 2940 NORTH DINNEEN
STREET from M-2 Heavy Industrial District to M-
1 Intense Commercial/Light Industrial District.
Ms. Stickle presented the recommendation of staff:
The subject site is approximately 1.48 acres and is located at 2940 North Dinneen Street and is
currently developed with an industrial structure.
The petitioner proposes to rezone from M-2 Heavy Industrial District to M-1 Intense
Commercial/Light Industrial District to make the zoning consistent on the entire property with
the intent to subdivide the property. Rezoning the subject site from M-2 Heavy Industrial District
to M-1 Intense Commercial/Light Industrial District would allow for all those uses permitted in
the M-1 Intense Commercial/Light Industrial District.
The surrounding zoning includes M-1 Intense Commercial/Light Industrial District to the north
and south and M-2 Heavy Industrial District to the east and west. The Macon County and
Decatur Comprehensive Plan shows this area as Heavy Commercial. The permitted uses in the
M-1 Intense Commercial/Light Industrial District are compatible with Heavy Commercial as
shown in the Comprehensive Plan. The proposed zoning is compatible with adjacent zoning and
uses in all directions.
The proposed rezoning of the subject site should have no adverse effect on the adjacent
properties or the City as a whole.
Staff recommends approval of the rezoning.
A motion to forward Calendar Number 17-38 to the City Council with a recommendation for
approval is suggested.
Mr. Jonas Ozier, representative, was sworn in by Mrs. Poland.
Mr. Ozier stated the petitioner discovered there was dual zoning at the site and would like to
have the zoning consistent in order to subdivide in the future.
There were no questions and no objectors present.
It was moved and seconded (Myatt/Newton) to forward Calendar No. 17-38 to the City Council
with a recommendation for approval. Motion carried unanimously.
