Excerpts from Plan Commission Meeting of September 7, 2017:
Cal. No. 17-39 Petition of KANE-YEH FAMILY LIMITED
PARTNERSHIP, AN ILLINOIS LTD.
PARTNERSHIP, to rezone property located at 960
EAST MOUND ROAD from B-3 Planned
Shopping Center District to 0-1 Office District.
Ms. Stickle presented the recommendation of staff:
The subject site is approximately 1.33 acres and is located at 960 East Mound Road and is
currently undeveloped.
The subject site was rezoned to B-3 Planned Shopping Center District in 1982 and was to serve
as part of the commercial area for a greater development that was to include a residential
subdivision.
The petitioner proposes to rezone from B-3 Planned Shopping Center District to 0-1 Office
District which would allow for all those uses permitted in the O-1 Office District.
The surrounding zoning includes R-1 Single Family Residence District to the north, south and
west and B-3 Planned Shopping Center District to the east. The Macon County and Decatur
Comprehensive Plan shows this area as Retail. The permitted uses in the O-1 Office District are
compatible with Retail as shown in the Comprehensive Plan. The proposed zoning is compatible
with adjacent zoning and uses in all directions.
Rezoning the subject site to O-1 Office District will make it more easily developed and create a
district that is a little more compatible with the surrounding uses.
The proposed rezoning of the subject site should have no adverse effect on the adjacent
properties or the City as a whole.
Staff recommends approval of the rezoning.
Section XXIX. of the City of Decatur Zoning Ordinance requires the Plan Commission to hold a
public hearing on a rezoning request, and then forward its report and recommendation to the City
Council for final approval. A motion to forward Calendar Number 17-39 to the City Council
with a recommendation for approval is suggested.
Mr. Ed Flynn, representative, was sworn in by Mrs. Poland.
Mr. Flynn stated the petitioner is proposing to open an optometry clinic and would like to rezone
the property.
There were no questions and no objectors present.
It was moved and seconded (Newton/Peoples) to forward Calendar No. 17-39 to the City
Council with a recommendation for approval. Motion carried unanimously.
