If traffic is found to be backing up on West Oak Lane, <br /> only "right-out" of the westbound traffic from the eastern drive aisle heading <br /> south shall be allowed. <br /> 4. West Oak Lane shall be improved from Water Street to the west side of the developed <br /> entrance on West Oak Lane, ending where the curbed radius ends. Improvements shall <br /> include increasing the road's strength to accommodate the increase in traffic, adding <br /> curb and gutter to both sides of the road with appropriate drainage structures, and <br /> extending sidewalk from Water Street through the developed entrance on West Oak <br /> Lane. <br /> 5. The access on West Oak Lane shall have signage posted for no right turns exiting the <br /> development. <br /> 6. The developer shall provide and remove striping as necessary for the vehicular <br /> movements and parking on West Ash Avenue as recommended by the Traffic Impact <br /> Study. <br /> 7. A one(1) lot subdivision plat will be required to be submitted, approved and recorded <br /> prior to a formal site plan being approved. <br /> 8. The only permitted uses for this Planned Development are retail; two (2) restaurants <br /> but no more than one (1) freestanding restaurant with a drive-through facility;medical <br /> and professional offices.No video gaming shall be permitted within this development. <br /> 9. Hours of operation shall only be permitted between the hours of 6:00 AM and 11:00 <br /> PM. <br /> 10.No outside speakers shall be permitted except for the drive-through facility with the <br /> restaurant. <br /> 11. The combined total square footage of all buildings shall not exceed 11,000 square feet. <br /> 12. All lights facing the west and south shall be shielded. <br /> 13. Building elevations and construction materials primarily of masonry shall be as <br /> approved by the Economic and Community Development Department in conjunction <br /> with the final site plan review. <br /> 14. Final site, landscaping and lighting plans shall be submitted to and approved by the <br /> Economic and Community Development Department, Public Works Department and <br /> the Fire Department prior to building permits being released. <br /> Section 3. That the Districts hereinabove mentioned are those districts set forth and defined <br /> in Ordinance No.3512 of the City of Decatur,Illinois,commonly known as the Zoning Ordinance, <br /> and all the provisions,regulations,restrictions and requirements therein set forth shall apply to the <br /> premises described herein. <br />
