HOLD HARMLESS AND INDEMNITY AGREEMENT
<br /> In consideration of the City of Decatur's participation in, and assistance in the 2018 Decatur
<br /> Celebration, and other good and valuable consideration,the receipt and sufficiency of which is hereby
<br /> acknowledged, Decatur Celebration, Inc. hereafter referred to as the Celebration,for itself,and its
<br /> successors and assigns, agrees to indemnify and save the City of Decatur, Illinois, its officers,agents,
<br /> and employees harmless against any and all loss,damages, and expense that it or they may sustain as
<br /> a result of any suits,actions, or claims of any character brought on account of civil rights violations,
<br /> property damage, injury to, or death of any persons,which may arise in connection with the use of
<br /> City of Decatur property, in connection with the 2018 Decatur Celebration on August 3,4, and 5,
<br /> 2018, by the Decatur Celebration, its officers, agents, employees,and participants, except as may
<br /> result from the sole negligent acts or omissions,or willful misconduct of the City of Decatur, Illinois, its
<br /> officers, agents, or employees.
<br /> The Decatur Celebration agrees to provide the City of Decatur evidence of third party liability
<br /> insurance coverage for the event in an amount not less than$1,000,000 per occurrence and
<br /> $2,000,000 aggregated,for violation of civil rights, property damage,and personal and bodily injury,
<br /> including death.
<br /> In addition,evidence of liquor liability insurance coverage for the event in an amount of not
<br /> less than$1,000,000 per occurrence and$2,000,000 aggregate shall also be provided.The City of
<br /> Decatur, Illinois shall be named as an additional insured on both policies for the duration of the event.
<br /> The Decatur Celebration's insurance will be primary.
