Ln� c2r� c , Intergovernmental Agreement Wildwood Sewer Repairs INTERGOVERNMENTAL AGREEMENT This AGREEMENT made this_L_ dayof _,2018,is between the Sanitary District of Decatur,Illinois,an Illinois unit of local gove nent("DISTRICT")and the City of Decatur,Illinois,a Municipal Corporation("CITY"). WHEREAS,pursuant to Article VII,section 10 of the 1970 Constitution of the State of Illinois, and the Illinois Intergovernmental Cooperation Act(5ILCS 220/1 et seq_),units of local government in the State of Illinois may contract between themselves to obtain or share services and to exercise or combine functions which either of the units of local government are authorized by law to perform;and, WHEREAS,there exists a sanitary sewer located on a tributary of the Ward Branch Creek located south of the Decatur Police Department that is in need of repairs; and, WHEREAS,the CITY agrees that the replacement of the City 8"sewer crossing replacement across the creek is the responsibility of the CITY,City Project 2018-18,and WHEREAS,the DISTRICT agrees that the stream channel modification and rehabilitation to protect the existing 15"sewer is the responsibility of the DISTRICT,and WHEREAS,the CITY and DISTRICT agree that CITY sewer and DISTRICT sewer need rehabilitated to protect the public and the environment. WHEREAS,the CITY requests that the DISTRICT manage the 8"sewer crossing as part of the Wildwood Sewer Repairs Project. NOW,THEREFORE,in consideration of the mutual covenants herein contained,the parties agree as follows: 1. AGREEMENT FOR CONSTRUCTION The CITY acknowledges and agrees that the DISTRICT will advertise and receive bids for the construction of the improvement and will award a contract for construction of the proposed improvement after receipt of a satisfactory bid in compliance with all applicable federal,state and local laws,rules,ordinances and procedures. The construction contract will be between the successful contractor and the DISTRICT. The DISTRICT will administer the contract. 2. EASEMENTS AND RIGHTS OF WAY The DISTRICT agrees to pay all costs to obtain title and/or access to the properties required for completion of this project. 3. CONSTRUCTION TIME The Wildwood Sewer Repairs Project shall be completed by December 31,2018 4. ESTIMATED PROJECT COST The following itemized list of Project Costs is included as a guide to estimate project AGREE- 1
