8. That at said delivery point or points, the Village shall furnish, install and maintain to City <br /> standards and specifications metering and regulating devices which shall remain the property of the <br /> Village and by it made accessible to the City for reading and inspection. Said metering and <br /> regulating devices shall be sealed against tampering or unauthorized adjustment and shall be <br /> promptly tested at the expense of the Village from time to time upon request in writing from the City. <br /> 9. The quantity of water furnished to the Village by the City shall be determined monthly at <br /> such time during the month as shall be determined by the City. Within a reasonable time after the <br /> quantity of water furnished is determined, the City shall bill the Village, and the Village shall, on or <br /> before the 14th day following the day on which the Village is billed, pay the City. The amounts <br /> charged the Village shall be determined by the application of the provisions of Chapter 64 of the City <br /> Code, which said amounts shall not exceed two (2) times the water charges for commercial monthly <br /> services situated within the corporate limits of the City plus applicable service charge. <br /> 10. In the event that the Village shall fail to pay the City for water furnished on or before the <br /> 14th day following the day on which the Village is billed, a penalty of five percent (5%) for each <br /> period of thirty (30) days or part thereof that the amount of such bill remains due and unpaid shall be <br /> added to the amount thereof and shall be paid by the Village. <br /> 11. In the event that restrictions upon the use of water, whether as to amount or type of use or <br /> otherwise, are established by the City for use of water furnished from the City water system, the <br /> Village shall establish and enforce the same restrictions in a like manner for water furnished from the <br /> system of the Village during said period, if the Village is using City water at the time pursuant to this <br /> Agreement. <br /> 12. As is currently ordained as to all water services furnished water from the water system of <br /> the City by the provisions of Chapter 64, Section 18 and 19 of the City Code, the City may terminate <br /> 3 <br />
