3. INTERIM CITY MANAGER DUTIES. During the Interim Period, Employee <br /> shall perform the duties and assume the responsibilities of City Manager as set forth in the <br /> applicable statutes of the State of Illinois, and more specifically Section 5-3-7 of the Illinois <br /> Municipal Code, [65 ILCS 5/5-3-7 (2016)], as may be amended, and all ordinances lawfully <br /> enacted pursuant thereto,together with all other such duties and responsibilities as the City <br /> Council may lawfully assign to Employee. <br /> 4. NO OTHER EMPLOYMENT. Employee shall devote all of his professional <br /> time, attention, knowledge, and skills solely to the interests of the City, and the City shall be <br /> entitled to all of the benefits arising from or incident to all work, services and advice of <br /> Employee. <br /> 5. OATH AND BOND. As a condition of this appointment, Employee agrees to <br /> execute and deliver an Oath of Office and be eligible for an official bond with surety, in <br /> substantially the forms attached in Exhibit A and as required by Section 5-3-9 of the Illinois <br /> Municipal Code [65 ILCS 5/5-3-9 (2016)]. <br /> 6. HOURS OF WORK. The Parties agree that the duties and responsibilities of the <br /> Interim City Manager will require the Employee to work weekends, evenings, and other irregular <br /> hours at locations, including the administrative offices of the City, as well as elsewhere, both <br /> during regular business hours and at hours beyond regular business hours. The Parties further <br /> agree that his work during irregular hours and at other locations are of equal importance and are <br /> included in the normal daily duties and responsibilities of the Interim City Manager. Employee <br /> shall perform such work at hours beyond regular business hours so in order to provide Employee <br /> with a reasonable limitation to the total number of hours required of him in the given week, <br /> Employee may reasonably determine his hours necessary to the position, but in no event shall the <br /> number of hours worked be less than forty(40) hours per week. <br /> 7. EMPLOYEE'S SALARY. Employee shall receive a salary at an annual rate of <br /> Fifteen Thousand Dollars ($15,000.00) in addition to the annual salary Employee currently <br /> receives in his current position including the additional pay for performance salary increase <br /> Employee would be entitled to receive for the 2018-2019 evaluation period ("Salary"), for the <br /> Interim Period payable in bi-weekly installments as per the pay plan generally applicable to all <br /> City Employees. Salary payments shall be subject to normal and customary tax withholdings. <br /> 8. VACATION LEAVE. Employee shall remain entitled to the same number of <br /> days of paid vacation leave during the Interim Period as Employee is entitled in his current <br /> position under the policies and plans of the City. Therefore, Employee's paid vacation leave <br /> shall not be altered, modified, or changed from that when he possesses in his current position. <br /> 9. SICK LEAVE. Employee shall remain entitled to the same number of days of <br /> paid sick leave during the Interim Period as Employee is entitled in his current position under the <br /> policies and plans of the City. Therefore, Employee's paid sick leave shall not be altered, <br /> modified, or changed from that which he possesses in his current position. Employee shall not <br /> be entitled to any cash payment, or payment of any type of paid sick leave days unused at the end <br /> of the Interim Period, and such paid sick leave days may only be utilized for illness of Employee <br /> of his immediate family members and will not be considered paid vacation days. <br /> 10. BUSINESS EXPENSES. The City shall reimburse Employee for all reasonable <br /> employment-related expenses, subject to administrative policies concerning such as currently <br />
